Putting a Leash on Therapy Animals

Institutions continue to define and refine their policies before student requests for pets come in.
In October 2011, the Department of Justice charged the University of Nebraska at Kearney in the U.S. District Court of Nebraska with refusing what it considers to be a reasonable request from a student for a service animal. According to the DOJ, Nebraska should have followed the guidelines in the Department of Housing and Urban Development’s Fair Housing Act, which considers emotional therapy animals to be service animals. policies had to comply only with guidelines set by the Americans with Disabilities Act (ADA), which requires them to allow service animals that are trained for particular tasks to aid individuals with disabilities. However, ADA strictly defines a service animal as either a dog or miniature horse “that is individually trained to do work or perform tasks for a person with a disability. . . .
