rule regarding what is considered
reasonable accommodation, it is
best to make such decisions with the
guidance of your institution’s legal
counsel or disability services office.
While the emphasis of Title 2 is on
accommodation, the emphasis of Title
3 is the need for public entities to
remove barriers.
One little known aspect of Title 2
is that every renovation project should
attempt to mitigate barriers along
what is called the path of travel, which
is the path a wayfaring person takes
from outside the building to their
location (whether it’s a classroom,
program space, or residence hall
room). For instance, if residence hall
floor restrooms are being renovated,
money should also be spent to
ensure that the path of travel to
that bathroom is disability friendly
under the ADA. According to the
Department of Justice, the ADA notes
that “alterations made to provide an
accessible path of travel to the altered
area will be deemed disproportionate
to the overall alteration when the cost
exceeds 20 percent of the cost of the
alteration to the primary function
area.” Enforcement of this particular
rule has become more prevalent, and
higher educational institutions are
advised to ensure that this 20 percent
rule is not forgotten.

Best Practices
What are campuses doing to
accommodate students with differing
abilities? Some schools are using
typical renovations to meet the
demands of students who need
increased access. Some schools,
when renovating their restrooms,
will make the minimum required
toilet stalls and sinks accessible for
guests in wheelchairs. Other schools
have done more. The University of
Iowa is systematically renovating
its former community bathrooms
into lockable individual restrooms
with toilet, sink, and shower. The six
individual restrooms on every floor
have a slightly larger footprint than
did the community showers, but they
create a sense of privacy for students
with medical issues. Each floor has at
least one ADA restroom with a roll-in
shower. Each restroom allows privacy
for transgender students and guests
or those who have Crohn’s disease,
irritable bowel syndrome, or a mobility
impairment.
The University of WisconsinWhitewater and the University of
Buffalo in New York have gone even
further by designing a residence hall
on the principles of universal design,
a term attributed to architect Ronald
L. Mace that describes the idea of
creating buildings or environments or

making products that are accessible
to both people with disabilities and
people without disabilities. UWWhitewater’s residence hall, which
opened in 2010, provides wheelchair
access in every suite. As Julie Sturgeon
notes in an article in University
Business, every counter is wheelchair
height, high-contrast floor and wall
coverings assist students with visual
impairments, and kitchens have
refrigerators with bottom-drawer
freezers. Essentially, a student with
any mobility limitation can navigate to
any space in the residence hall.
The University of Buffalo has
many of the same universal design
amenities as UW-Whitewater. Greiner
Hall, UB’s new 600-bed, six-story
residence hall, boasts all suite-style
room types with two rooms sharing
an oversized bathroom. As described
by Charlotte Hsu, media relations
manager at Buffalo, other highlighted
features include high-contrast wall and
floor coverings and electrical outlets
at a comfortable reach for students in
wheelchairs. First occupied in 2011,
the building will house sophomore
students.
