5. What relationship
does housing have with
institutional legal counsel?
It is important to establish a
relationship with the institution’s legal
counsel and to ensure that the housing
division understands how they interpret
the law. “Does your legal counsel say
you fall under the Fair Housing Act
(FHA)? Are you required to provide
single-occupancy rooms at a reduced
room rate? If you don’t have answers to
these questions, you may be headed for
trouble,” Terrell cautions.
Some staff find it beneficial to
have ongoing meetings with legal
counsel to ensure that they are doing
everything within reason to make
accommodations appropriately. Legal
counsel will let you know if you are
doing everything required to provide
accommodations under the law and
can provide advice on how to be
consistent when making reasonable
accommodations.

6. how does the institution’s roommate and/or room selection process support
students with disabilities?
Make sure students who have an accommodation request have the same opportunities available to them
as students who do not. This means providing access to roommate matching services and room selection
processes, should they choose to pursue those opportunities. “Students with disabilities are highly capable;
they may just need more resources than other students. It is our responsibility to ensure that our processes,
like roommate matching, do a good job of matching students together without requiring students to disclose
information about their disability they may not wish to disclose,” Terrell says.
For those who provide an online room selection process, McGownd has this advice: “After room retention
has been completed in the spring semester for students reapplying for the next academic year, we close all
available ADA spaces. Any spaces not used to satisfy an accommodation request are released over the summer
for use by the general population. We have several rooms at various price points that have been modified to
accommodate specific needs. We try to maintain at least one space in each accommodation type until July 1. Any
request received after July 1 is not guaranteed.”
As with any other room assignment, it is important to make sure you are transparent in your processes and
provide all the information (such as forms to complete, important dates, definitions of terms, and room types
available) needed. An institution should feel confident that they are doing as much as possible to accommodate
students with disabilities. As Terrell advises, “Try to find a way to say ‘yes’ to the accommodation request
however possible. At the end of the day we’re here to support students. We don’t ever want to be the reason a
student doesn’t succeed.”
