ACUHO-I Reps Visit Washington, D.C.,
to Talk About the Affordable Care Act
When the Affordable Care Act (ACA)
became law in March of 2010, one
of the largest ripples came from the
provision that a large employer must
either offer full-time employees (and their
dependents) certain insurance coverage
or pay certain penalties. Under this
definition, a college or university with 50
or more full-time equivalent employees is
considered a large employer and subject to
the employer mandate.

Causing further issues for campus
housing departments in this position is
the large number of student employees
they must hire, particularly for resident
assistant positions. The challenge of
how to track the hours of these staff, and
whether or not that would make them
eligible for coverage, has resulted in
multiple interpretations of how the law
should be observed.
To help rectify the issue, the United
States Treasury recently brought together
representatives from different college
and university populations to discuss the
impact of the ACA on their practices.
Among those, representing ACUHO-I
and the campus housing profession,
were Steve Waller, executive director
of residential life at Louisiana State
University in Baton Rouge, and Kathy
Bush Hobgood, the director of residential
life at Clemson University in South
Carolina.
At the meeting in Washington, D.C.,
the two presented the Treasury with a report
providing background on resident assistants, the
work they do, how they are compensated, and
some of the unintended consequences that have
arisen from current ACA interpretations. The
report expressed the desire for clear guidelines
about the status of resident assistants and how to
compute working hours for such positions.
Later, reporting to the ACUHO-I Executive
Board, Hobgood and Waller explained, "The
Treasury staff we met with were very open to our
concerns and seem very interested in working
with us to develop solutions to our concerns.

They realized resident assistants were a unique
group and recognized they needed help from us
to bring possible solutions back to the table."
The Treasury Department currently has taken
ACUHO-I's recommendations regarding RAs as
well as those from other groups regarding student
employees such as rec sports staff, graduate
teaching assistants, and graduate research
assistants. An update is expected later this year.
