the new FLSA rules, a bonus may fulfill up to 10
percent of the standard salary test requirement.
The stipulations are that the bonus must be
nondiscretionary and that the bonus or award is
paid on a quarterly basis or more frequently. In
this case, "nondiscretionary" means that the bonus
is tied to productivity, efficiency, or organizational
loyalty. Examples of a nondiscretionary bonus
are commissions on sales or a periodic award
for continued service to the organization. The
amount and award of a discretionary bonus, on the
other hand, is completely the employer's choice
and doesn't adhere to any specific qualifications
or standards. An example is a holiday bonus;
it's spontaneous and not specifically tied to
performance or loyalty metrics.
Another alternative to traditional compensation
available to public institutions is compensatory time
or "comp time." The final rules stipulate that comp
time can be used in place of cash compensation
for up to 240 hours. While this allows institutions
some leeway, many have cautioned over-reliance
on this option. As an example, while an employee
could accrue as many as six weeks' worth of comp
time during busy seasons such as move-in, this

would likely result in them being absent from
campus for an extended period during other parts
of the year even though their presence is no less
necessary. "To me, part of the danger is tracking all
of that and using it in a planful, controlled fashion,"
Bush Hobgood pointed out. "Is it better for me to
pay a little bit of overtime as we go along or to end
up with someone whose overtime limit has to be
then cashed out, which could be a check for three to
four thousand dollars?"
Using comp time can also depend on whether
or not the campus has a collective bargaining
agreement with staff. To this end, Adams noted
that institution type and unionization determine
whether this is even an option. "If you're public
you have the option to do that if there isn't a
superseding document." At MSU, the employees
are nearly all unionized, with the exception of
the faculty. The union contract stipulates that
employees can choose comp time or overtime pay,
and the institution is not allowed to dictate the
choice. However, at some institutions awarding
comp time may be a viable option.
