RAs and respond to
their concerns.

that supervisors who learn of organizing activity notify senior management
so it can take lawful steps to respond.
If a petition for an election is filed,
the institution must then provide the
names and contact information for the
students within two days of the petition, and it must file a statement of its
legal position within seven days of the
filing of the petition. There may be a
hearing about the election details, and
then an election is typically scheduled
within approximately three weeks of
the filing of the petition. The institution must then give even more detailed
information to the union about the
voters - including phone numbers
and known email addresses - and
both the union and the institution can
campaign to convince voters to vote
for or against the union. Students who
signed authorization cards are not
obliged to vote for the union, however.
The outcome of the election is determined by the majority of votes cast on
the day of the election.

If a union wins an election, the
institution must then bargain with the
union over terms and conditions of employment. In the case of RAs, this could
include a definition of on-duty hours,
the amount of compensation, the job
description, the discipline process, job
posting, and many other issues that
may be raised during bargaining. If the
union loses the election, it cannot seek
another election for one year.
Because this process moves quickly
and involves very complicated rules
about what can and cannot be said
during a campaign, it is urgent for any
institution to be prepared to deal with
organizing.
Most importantly, each institution should assess its position on the
unionization of residence life employees. To make an educated decision, it is
important to educate relevant administrators about the union organizing
process under the Act. An organization
should identify a response team in the
event of organizing as well as assess the
