If those sections are invalidated, DEP
is likely to appeal, Slagel predicts. Once
Chapters 78/78a are promulgated and
ripe for a challenge, the oil and gas
industry probably will file suit against
all or parts of the rules package, he predicts.

Spring Meeting
Slagel says PIOGA's spring meeting
will be held at the Rivers Casino on the
North Shore of Pittsburgh.
"PIOGA hopes that moving the meeting to a new venue such as the casino
will create a bit of buzz and additional
enthusiasm for the program," he says.
"Also, the association is trimming the
schedule from a day and a half to basically a day that starts in the morning
and ends in the late afternoon with a reception. Then, everyone is cut loose to
either go home or spend some time in
the casino."
Slagel says PIOGA members realize
they can do little to affect global oil and
gas prices, but they appreciate their association's role in meeting challenges at
the state level, and also having a voice
on federal issues.
"We have to stay optimistic," Slagel
exhorts. "We don't have the option to

take our bat and ball and go home. Our
most immediate concern is with conventional producers' ability to hang on. PIOGA is doing what it can to help and
give them some encouragement and hope
for the future. A number of our talks at
the spring meeting will provide helpful
information to maybe ease some of the
pain for both segments of the industry,
as well as the midstream sector."
In addition to state and federal regulatory updates, D'Amico says meeting
speakers will cover industry issues such
as overtime pay, water management and
legal issues. Joyce Turkaly, director of
natural gas development for PIOGA, will
lead a panel discussion on developing
new gas markets. He adds one of the
panel's topics will be HB 1731, the Keystone Energy Enhancement Act, which
offers 10 years of tax incentives for heavy
natural gas users such as petrochemical
manufacturers to develop brownfield sites.
"PIOGA has high hopes that the Energy
Enhancement Act will increase gas usage
in Pennsylvania," D'Amico says. "I don't
know what it can do, but it is encouraging
that some folks in government understand
that this is a good thing and want to
make it happen."
