President Edward Cross reported that he
had discussed the subject with regulators
in his state, and said they tended to emphasize that the pertinent portion of
RCRA was unenforceable. "They think
it is of no concern," he said. "But they
listen when you mention citizen lawsuits."
That is because, Fuller warned, even
though RCRA does not require states to
adopt federal guidelines for oil field
waste, the existence of such standards
may invite litigation. "You can comply
with state regulations, but if the state
regulation does not follow federal guidelines, it creates a pathway to a citizen
suit against the producer," he detailed.
"That is why we want EPA to say the
STRONGER review process makes federal
guidelines unnecessary."
NAFTA And Natural Gas
Texas Alliance of Energy Producers
President and Chief of Staff John Tintera
said his members hoped the Trump administration's efforts to renegotiate the
North American Free Trade Agreement
would not hurt U.S. producers. He indicated the Alliance was trying to preserve

Mexican outlets for U.S. natural gas.
"Mexico needs the gas; we need the
market; natural gas prices are still historically low;" he described. "We are very
concerned about anything impacting markets in any way. As NAFTA is renegotiated, we hope the (natural gas) contracts
and framework can be set aside. We are
not hearing a lot of complaints from companies that are trading with Mexico. It
seems to be going well. Everyone wants
stability in that trading process."
Tintera also emphasized the importance
of getting that gas to market. "Way too
many Texas wells are flaring," he considered. "We would like to get that gas to
market."
Liaison Committee Chairman Mike
Elyea, senior vice president of Burk Royalty Co. in Wichita Falls, Tx., echoed
that point. "We have a real issue in the
Permian Basin," he related. "The industry
has gotten ahead of the infrastructure.
There is a market and there is a pipeline,
but it is filled to capacity. About every
new well we have in the area must be
either flared or shut in. There is no quick
solution."
To address such situations, Tintera
mentioned, the Alliance has been working
with a company that offers skid-mounted
