with appropriate protective measures on
all mineral estate designated as open, the
agency says. Therefore, it adds, BLM
need not lease and develop entirely outside
of habitat management areas before it
can consider leasing and development
within those areas.
The oil and gas leasing IM replaces
IM 2016-143. BLM says the document
will ensure consistency, certainty and
clarity when implementing an objective
in the 2015 Greater Sage Grouse Approved
Resource Management Plan Revisions
and Amendments (GRSG plans) to prioritize oil and gas leasing outside of the
greater sage grouse habitat, while allowing
leasing and development to move forward
while providing protections to the birds
and their habitat.
BLM says the GRSG plans are designed to prioritize oil and gas leasing
and development outside of the sage
grouse's habitat management areas,
while allowing for leasing with appropriate stipulations on all BLM mineral
estates designated as open for leasing
under the plans.
"In effect, the BLM does not need to
lease and develop outside of GRSG habitat
management areas before considering
any leasing and development within GRSG
habitat," the agency says. "This policy
should allow for the BLM to efficiently
conduct lease sales and permit oil and
gas development while still protecting
GRSG and GRSG habitat."
Where the BLM has a backlog of expressions of interest for leasing, it says it

Stipulations, including no surface occupancy or controlled surface use agreements, may be used as BLM implements
the GRSG plans. The agency points out
it can use those stipulations to encourage
lessees to work with parties who file expressions of interest outside of the highpriority management areas because of
fewer restrictions in those areas. In addition, BLM says it continues to work
with parties who file expressions of interest and potential lessees to voluntarily
prioritize leasing in less-sensitive areas.
The agency notes that, consistent with
the GRSP plans, parcels may be leased
within GRSG habitat management areas
without first leasing parcels outside
habitat areas.
The agency says it will continue to
work cooperatively with stakeholders, including state agencies, lessees, operators,
landowners and leasing proponents to
avoid and minimize impacts to designated
GRSG habitats. BLM adds its offices
may weigh other priorization considerations, but only insofar as they are consistent
with the governing land use plan. Such
considerations include office workload
capacity, first-in/first-out, priority for unit
obligation wells, processing the easiest
applications first, operator drilling plans,
operator proposals for units, potential
drainage cases, and other resource values
that must be considered.
