PHMSA in conjunction with the
Federal Railroad Administration
announced the rule on June 19. It allows
LNG to be transported in DOT113C120W9 specification tank cars
with enhanced outer tank requirements
(AOGR, July 2020, pg. 16). The rule,
which was published in the July 24
Federal Register and became effective
Aug. 24, also requires remote
monitoring of the pressure and location
of LNG tank cars; two-way, end-of-train
or distributed-power-system braking
when a train is transporting 20 or more
LNG tank cars in a row or 35 or more in
total; and route-risk assessments to
evaluate safety and security. r

Federal Court Keeps
Coastal Lawsuits In
Louisiana State Courts
BATON ROUGE, LA.-While
disappointing, an August ruling by the

U.S. Court of Appeals for the 5th
Circuit that two lawsuits seeking
damages from oil and gas companies
for coastal erosion must remain in state
courts will not deter their defense, say
two Louisiana producer associations.
Published reports say the 5th Circuit
on Aug. 10 upheld a lower court ruling
that coastal lawsuits filed by Cameron
and Plaquemines parishes should not be
moved to federal jurisdiction.
In a joint statement, Louisiana Oil &
Gas Association President Gifford
Briggs and Louisiana Mid-Continent
Oil & Gas Association interim President
Lori Leblanc respond, "To be clear, the
5th Circuit's decision has no bearing on
the facts of the case nor the merits of
the issues raised by the defendants in
the litigation. Whether these cases move
forward in federal or state court, we will
continue to defend against the meritless
cases and show why the lawsuits do
nothing for Louisiana's coast."
The Grow Louisiana Coalition of
allied businesses also expresses
disappointment, stating, "Since 2015,

Louisiana's oil and gas industry has
paid $230,115,049 directly into coastal
building and protection projects in
South Louisiana. These lawsuits and the
small group of trial lawyers pursuing
them have not produced one dollar for
the coast."
According to published reports, the
oil company defendants had petitioned
to move the cases to federal court based
on an expert report filed by one of the
parishes that some of the wells involved
were drilled during World War II under
wartime regulation, which raised a
federal issue that should be heard in
federal court. The oil companies argued
this was new information not
considered in the court's earlier ruling
to keep the lawsuits in state court.
But the 5th Circuit disagreed,
writing, "We conclude the information
disclosed did not provide new
information previously unavailable to
the companies."
Although the 5th Circuit ruling
involved only two of the 42 lawsuits
filed against more than 200 companies
