Coalition Of 25 AGs
Urges FERC To Back Off
LNG-By-Rail Reversal
BATON ROUGE, LA.-A 25member
coalition of state attorneys
general are questioning the Biden
administration's plan to suspend a
regulation enacted during the Trump
administration to authorize rail tank cars
to transport liquefied natural gas. Led
by Louisiana Attorney General Jeff
Landry, the coalition has penned a letter
to Pipeline & Hazardous Materials
Safety Administration Acting
Administrator Tristan Brown asserting
that the agency has breached
rulemaking protocol, overstepped its
jurisdiction and placed upward pressure
on consumer energy costs.
Proposed in November 2021,
PHMSA's suspension plan is a
product of Biden's Executive Order
13990, which directs agencies to
review Trump-era rules to identify
" candidates for suspension,
modification or recission because of
inconsistency with administration
policies to . . . prioritize
environmental justice and reduce
greenhouse gases, " the AGs' letter
notes. However, the letter continues,
PHMSA's decision to revoke LNG rail
transport authorization creates
uncertainty and discourages capital
investment in tank cars specifically
designed to transport LNG.
The AGs' letter argues that
PHMSA's proposal suffers from five
additional flaws:
· Its claim that transporting LNG
by rail tank cars poses 'unreasonable
risks' to public safety is inconsistent
with PHMSA's prior position.
· Preventing LNG by rail harms the
U.S. economy and-because gas
infrastructure limitations can lead to
flaring-undermines efforts to limit
greenhouse gas emissions.
· It exerts upward pressure on
energy costs and displaces U.S. supplies
in favor of imports.
· It has especially keen national
security implications amid a period of
geopolitical tension.
· PHMSA is operating beyond its
statutory authority.
On the last point, the letter says,
" PHMSA admits the purpose of the
proposed rule is not really about safe
transportation of hazardous materials in
interstate commerce. Rather, it is
intended to indirectly regulate the
