taken no action, the attorney general recommended that a
single agency, the Bureau of Consumer Affairs, become the
active supervisor for all boards, which would likely move
much decision-making from the professionals to the bureaucrats. A handful of states have established an active supervisor-ranging from Connecticut's Department of Health for
health-related boards to Oklahoma's attorney general and
Georgia's governor.
How Can State Podiatric and
Other Boards Respond?
Certainly, professions can seek out state policymakers to
influence an active supervision regime. It may be preferable
to have an active supervisor familiar with the profession, or
alternatively, one whose role is limited to a narrow legal analysis. But an important first step in deciding who should be
the active supervisor is to determine how he or she would
oversee a board.
Another solution not yet pursued by state boards in direct
response to the NC Dental Board decision is to indemnify
board members for antitrust liability. Some states, including
New York, already provide indemnification broadly for official actions. Nonetheless, a state-specific legal analysis should
be performed to evaluate how a particular state's laws regard-

ing defense and indemnification might apply to anticompetitive board decisions.
While boards of podiatry must be careful not to cross the
legal limits of the NC Dental Board decision, podiatrists can
also avail themselves of the recent attention on anticompetitive concerns. For instance, if podiatrists' scope of practice is
threatened or limited, the heightened climate around competitive health-care services could be used to promote podiatrists. The FTC has been increasingly active in providing
advocacy letters warning state legislatures and regulatory entities when bills and proposed rules would have an anticompetitive effect. Thus, while shielding podiatrists serving on state
boards is paramount, it is worth considering how the NC
Dental Board decision may also be wielded as a sword to protect the podiatric profession from competitive harm resulting
from the actions of other state boards.
