Dias has Loose nut causing crash was Volvo's fault, judge rules
lived the
union life

Labour Council, and then to
a job on the line at General
Motors' large van assembly
plant in Scarborough where he
fitted the front bucket seats.
In 1984, though, he found
himself on strike. It was a
tough strike too, and created the Canadian Autoworkers
Union when it broke away
from the United Auto Workers
union.
In the middle of that strike,
Dias was recalled by De
Havilland. He went back to his
old job, but moved on there
within the union to become the
plant chairman and, finally, the
president of Local 112, just like
his dad.
In 1993, he joined the national union as the aerospace sector co-ordinator, and then, in
2007, became an assistant to
then-president Buzz Hargrove
and later to Hargrove's successor, Ken Lewenza. The rest is
history.
Talking on the phone from
Ottawa right after Unifor's convention, Dias did not want to
discuss his family. "They're not
a part of this at all," he said.
"When we're in contentious
bargaining, I get a lot of emails
and phone calls. People tend
to be aggressive ... I've had to
press charges."

A BRITISH COLUMBIA
Supreme Court justice has
awarded $4.87 million in a product-liability case against Volvo
Truck North America.
The suit stems from a
2009 nighttime crash
in which a fully loaded
2008 Volvo 670 truck lost
all electrical power on
a highway in Manitoba,
jackknifed during a
light snow shower and
landed in a ditch.
The award went to the
owner-operators who leased
the truck, Amandeep and
Pavandeep Hans, for post-trau-

matic stress syndrome and
other psychological injuries,
plus lost earning capacity and
other damages. Neither suffered
physical injuries, the decision
said. Volvo has appealed.
According to the decision,
the Volvo 670 developed other electrical
problems shortly after
the plaintiffs got it.
The suit alleged negligent design, manufacture or installation of a
positive terminal electrical connection that
became loose. Volvo
admitted a loose nut was the
cause but denied liability.
Justice Barry Davies said
evidence at trial "leads to the

irresistible inference that the
nut was negligently installed by
Volvo."

The store replaced the battery but MacDowell chose to
have all other repairs done by
another mechanic because she
distrusted the store, the decision said. She sued after the
store refused to reimburse her.
Deputy Judge Abraham
Davis said MacDowell hadn't
initialed the "as is" clause in
the sales contract, and thus the
store represented the Protege
as "roadworthy, mechanically
sound or maintained at a guaranteed level of quality."
He said the car's safety standards certificate was misleading
or false and the required presale inspection hadn't been performed. - ANC

CAR DIES ONE DAY AFTER SALE

A small claims court judge
in Richmond Hill, Ont., has
ordered a used-car store to reimburse a purchaser $2,251 for
repair costs she incurred elsewhere.
In November 2013, a salesman for Autodrive of Canada
Corp. told Karen MacDowell
that the 2003 Mazda Protege5
was certified and "e-tested with
a warranty," but it died the day
after she bought it, the decision
said. Later inspections found
serious problems, including
"ineffective brakes" and rust

He speaks passionately, however, about his involvement
with Halton Women's Place, a
women's shelter in Burlington,
Ont. Every year, he participates
in the Hope in High Heels Walk,
tottering a couple of blocks in
high heels to raise money for
the charity, and it's estimated
he has raised about $300,000 in
the last five years.
"I just remember being
moved by the pictures in the
newspaper of the men walking
in high heels," he said. "The
first march we went on, there
were probably 20 men. Last
year, there were probably closer to 200 men."
"We couldn't do what we do
without him," says the shelter's executive director, Diane
Beaulieu. "He raises awareness
not only because he's the head
of Unifor, but also because he
speaks of women's issues in his
work for Unifor."
When he gets a chance to
relax, Dias still works out regularly at his home gym -
"though there's been some
slippage," he concedes - and
finds peace on the water on a
13-metre powerboat he moors at
one of the Toronto Island marinas.
There won't be much time
for relaxation in September,
though. Unifor wants renewed
commitments to Canadian auto
workers and new investments.
With the support now of the
federal government, Dias says
he's looking forward to the
negotiations.
"We've got some major challenges," he says.
"The reality is, we're going
to find solutions." - ANC
