Liberty notes Protections for the accused in the Fifth Amendment Key rights secured by the Fifth Amendment include the right to no double jeopardy and the right not to testify against oneself. Both are very important to protect the rights of someone accused of a crime and to ensure that justice is served. The Double Jeopardy Clause in the Fifth Amendment protects a citizen from being charged with the same offense after being found innocent, or acquitted. It reads, “nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb.” From this clause comes the term “double jeopardy.” There is an exception to not being tried again for the same crime: Someone acquitted of a state offense may be charged with a similar offense under federal law, or viceversa. This is not considered double jeopardy. The popular term “taking the Fifth” originates from the next More online at www.georgiamagazine.org clause in the amendment, the SelfIncrimination Clause: “nor shall be compelled in any criminal case to be a witness against himself.” The legal dictionary at thefree dictionary.com, under the entry “selfincrimination,” says, “The Founding Fathers drafted the Fifth Amendment to forestall the use of torture and other means of coercion to secure confessions. The founders believed that coerced confessions not only violate the rights of the individual being interrogated but also render the confession untrustworthy.” For these reasons, citizens are protected from self-incrimination in legal proceedings by the Fifth Amendment. —Jim Jess For more about the Fifth Amendment, see page 50B of the July 2011 digital edition online at web exclusive www.georgiamagazine.org.
