Georgia Gold Medal Plant of the Month A summer bloomer! BY CONNIE COTTINGHAM I t’s summertime, and you’ve seen them all over: 3-foot-high shrubs covered with yellow, pink and orange blooms and butterflies. A little wider than tall, Miss Huff Lantana, Lantana camara ‘Miss Huff,’ dies back to the ground in the winter, takes a little time emerging in spring, then blooms her heart out when the summer gets hot. This lantana is reported to be perennial as far north as Canton. The only maintenance needed for Miss Huff Lantana is to cut back the old stems before new growth emerges in the spring. As this case illustrates, the life, liberty and property interests of citizens, which are protected by due process in the Fifth and 14th amendments, have been defined quite broadly by the courts, thereby upholding the rights of the individual over the interests of the government. Due process protections have been applied to a variety of situations by the courts, and not only to courtroom procedures. The U.S. Supreme Court has extended due process protections to legislative as well as agency actions. In 1925, the Supreme Court ruled in Pierce v. Society of Sisters that an Oregon law violated due process by depriving parents of the right to send their children to private schools. In order to fulfill the state’s educational requirements under the new law, parents were required to send all students between the ages of 8 and 16 to a public school. The court said the August 2011 law “unreasonably interferes with the liberty of parents and guardians to direct the upbringing and education of children under their control. … The fundamental theory of liberty upon which all governments in this Union repose excludes any general power of the State to standardize its children by forcing them to accept instruction from public teachers only.” The court went further to consider the business and property interests of the Society of Sisters, a nonprofit corporation that operated a private school.
