Presidential appointments … he [the president] shall nominate, and by and with the advice and consent of the senate, shall appoint ambassadors, other public ministers and consuls, judges of the supreme court, and all other ofﬁcers of the United States, whose appointments are not herein otherwise provided for, and which shall be established by law. … —U.S. Constitution, Article II, Section 3 The Constitution gives the president the power to appoint federal ofﬁcials and military ofﬁcers, but the Senate, through its power of “advice and consent,” can approve or refuse an appointment. The president ﬁlls thousands of ofﬁces by appointment over the course of a four-year term. According to the U.S. Senate website, www.sen ate.gov, “Approximately 4,000 civilian and 65,000 military nominations are submitted to the Senate during each two-year session of Congress.” Not all presidential appointments require Senate conﬁrmation, but the principal ones do. Cabinet secretaries, certain agency heads, ambassadors, military ofﬁcers, federal judges, U.S. attorneys and U.S. marshals must all receive Senate conﬁrmation. According to Trent England, legal policy analyst at the Heritage Foundation, a Washington think tank, writing in “The Heritage Guide to the Constitution,” the federal appointment process involves several steps. After the president makes a nomination, the Senate must vote to approve or reject it. The Senate process involves a number of steps, including committee hearings, a committee vote and an eventual vote on the ﬂoor of the Senate. Finally, if the Senate conﬁrms the appointment, the president commissions the new ofﬁcer, according to the last sentence of Article II, Section 3.
