The Occupational Safety and Health
Administration (OSHA) has exempted "Wyoming or Western-type
sodium bentonite deposits" from its
rule for occupational exposure to
respirable crystalline silica.
As noted in the preamble to the
rule, OSHA determined "that quartz
originating from bentonite and
similar sorptive clays is considerably
less toxic than unoccluded quartz,
and evidence does not exist that
would permit the Agency to evaluate the magnitude of the lifetime
risk resulting from exposure to silica
in sorptive clay deposits. OSHA is
therefore excluding sorptive clays
from the scope of the rule."

United Rentals
United Rentals Inc., the world's
largest construction equipment
rental company, will buy Neff Rental
for about $1.3 billion, topping a
previous offer of about $1.2 billion
from H&E Equipment Services Inc.
United Rentals will pay $25 per
share, representing a 26.9-percent
premium to Neff stock price prior to
the H&E deal. According to United,
it paid H&E a fee of about $13.2
million for terminating the Neff deal.
Earlier, H&H said it did not intend to
submit a revised offer, sending Neff
shares down 6 percent.
Neff is expected to generate
$419 million of total revenue for the

full year, the companies said.
Stamford, CT-based United is
an equipment rental company that
serves construction companies,
utilities, municipalities and homeowners.
