The Ontario Broker - April 2019 - 11

TM: To date, we've had a few calls with questions on where people can
smoke in restaurants and within commercial space. We've been advising
them that the same rules apply as with cigarettes.
SO: My clients haven't asked me about this topic, but I take the time to
remind them about Ontario's driving impairment laws and how they apply
to cannabis consumption.
DR: It's been a non-issue with Personal Lines clients. From a Commercial
Lines perspective, we're hearing a consistent message around cannabis use
in the workplace and the possible impact on workers, management and
respective liability-workplace safety. We developed a standard template for
our clients to update language in their workplace policies, procedures and
employee handbooks. Where the client need is greater, we introduce them to
our labour and employment law specialists to work with directly.
HAS OR WILL A RETAIL STORE OPEN IN YOUR
NEIGHBOURHOOD?

JG: St. Thomas City Council voted in favour of allowing retail cannabis
stores to open in January this year. The reaction from residents has been
discernibly split. Most in favour fear that opting out allows illegal cannabis
sales to flourish. Those against it are concerned about long-term health
effects, the cost to first responders and the general feel of the city.
TM: There won't be a retail store in our town, but Smiths Falls is home to
Canopy Growth, a cannabis company located in the old Hershey Factory.
When it was first proposed, people were against the idea of having a
'marijuana grow-op' in their backyard. Since legalization, the town's
embraced the company-there have been many positive outcomes including
an influx of business and new residents and a general boost to the economy.

UPON
INSPECTION,
IT WAS
DISCOVERED
THE HOME WAS
USED TO GROW
CANNABIS.
THE DESIRE
TO INSURE
THAT HOME
DECREASED
SIGNIFICANTLY
DUE TO THE RISK
OF MOLD AND
ALTERED WIRING
AND ELECTRICAL.

SO: City Council approved cannabis stores to operate in the city, and we're
getting a store down the street from my residence. The reaction in London
has been overwhelmingly positive, at least among those I've spoken to.
DR: A store is slated to open in April. As expected, the community's
response has been mixed with really no overwhelming majority on either
side of the issue.
HAVE YOU ENCOUNTERED CANNABIS USERS BEING
DENIED COVERAGE?

JG: Our office hasn't encountered any issues with clients being denied
insurance.
TM: Not yet, but I did have a case of an apartment building owner who had
complaints from one of his tenants about another tenant smoking cannabis
in common areas.
