Maine Condominium Boards’ and Owners’ Concerns Addressed
ith more than 100 condominium board members, owners and industry professionals in attendance, speakers addressed topics ranging from implications of the Maine Condominium Act amendments, effective September 2011, to collections and foreclosure administrative rules and policies. Among other things, the 2011 amendment provisions allow associations to more easily borrow money, establish what records need to be retained and for what period of time, extend association liens from three to five years, suspend privileges of owners who fail to pay an assessment and in addition, clarify owners’ rights to attend and receive notice of meetings of the association board. Speakers Joseph Carleton Jr., Esq. and Bruce McGlauflin, Esq. provided guidance to associations in complying with the amendments and specifically addressed a number of ways to facilitate the board meeting notice requirement and establishing

reasonable rules for board meeting attendance. Douglas Britton, Esq. outlined a framework for effective collections, with detailed information on establishing effective collection policies and procedures. In addition, an overview and discussion of condominium liens and foreclosure, the bank foreclosure process and bankruptcy, provided an understanding of the procedures, problems and timeframes. An afternoon panel discussion with industry professionals provided answers to questions ranging from insurance and reserves to maintenance and landscaping.
