What to Do About Drones
R
eading recent news reports
about drones and all the
possible uses for them, we
began to wonder: Will drones
delivering pizzas and packages create
specific problems for community
associations? What about owners
who acquire drones for (who knows
what) personal uses? If a drone falls
on an owner's car - or on an owner
- will the association be liable for
damages? Can associations make
their communities "no-fly zones"
for drones (and should they)? The attorney and insurance experts to whom
we posed those questions agreed it
is too early to provide much detailed
guidance on drones. But they also said
it may not be too soon for community
association boards to start thinking
about them.

and others in the future, Meskin says.
While he thinks those problems are
more theoretical than real and far
from imminent, he agrees that associa-
ment guarantees a level of security, by
providing it, the association "assumes
liability it shouldn't take on," Meskin
cautions.
As drones become more affordable, some consumers
will want to own them. And condo owners flying personal drones in common areas will almost certainly be
accused of violating the privacy of other residents.

association in its right mind would
own one." The only purpose a drone
would serve would be for securityrelated surveillance, and Meskin has the
same concerns about drones that he
has about any surveillance equipment:
"More often than not, [the surveillance] isn't effective." But because
residents assume surveillance equip-

board and an owner complains about a
drone flying in the community, I'd say
that's between the drone owner and
his or her neighbors and tell people
complaining about the drone to call
the police."
