If you're reading this column, you're in the process of examining the first issue of Condo Media in an exciting new format. We hope you enjoy
it. Each issue will still have an overarching theme.
This month, the theme is communications. Regional
columns, such as this one, are tasked with providing
regional news.
As I am virtually never short on words (I can almost
hear the thoughts of those of you who know me!),
I will attempt to both provide regional news and to
touch upon the issue's theme from a legal perspective.
As to news, by the time you read this, the results
of the November election will be known. In fact,
inaugurations for the newly elected officials will be
underway. You may recall from prior columns that
several pieces of potential legislation impacting New
Hampshire associations may be taken up in this next
legislative session. The particular legislators holding
office will control the amount of enthusiasm and the
manner in which these prospects are pursued. Issues that could be raised include amendments to the
Condominium Act regarding provisions on property
manager licensing, property management contracts,
association record keeping, and qualifications for
serving on a board.
As to communications, from a legal perspective,
they are our stock in trade and the bane of our existence. Whether a particular communication is classified as the former or the latter depends on the type
of communication involved and how carefully it was crafted. Verbal
communications are susceptible to all potential pitfalls. After the
fact, parties may claim that a verbal communication involved different wording than that which was actually spoken. Or, it can be difficult to prove that a verbal statement was ever uttered at all. If you
believe that a situation is or might be a legal dispute, written communication may be the better option. That said, a poorly drafted
off-the-cuff written communication (e.g., a quick, emotional email)
can certainly lead to trouble. And, if the tone is vague, the recipient
might assume the worst and escalate the situation unnecessarily.
USE CAUTION WITH EMAIL
Emails are increasingly uncovered in the discovery process and used
as evidence in litigation. A better choice is a well-drafted letter. Carefully selected words will best demonstrate your point and convey the
intended tone. A well-written formal letter also makes for a quality
evidentiary document.
