engage in an interactive process with the
employee/resident. In Barbuto, the SJC
held that the failure to explore a reasonable accommodation alone is sufficient
to support a claim for handicap discrimination. Thus, it is imperative that both
employers and condominium boards
engage in an interactive dialogue with
the disabled person once the request for
an accommodation is made, or the need
for an accommodation is apparent.
The interactive process allows the
parties to discuss and identify an ap-

propriate accommodation to allow the
disabled person to "use and enjoy a
dwelling" or be a "qualified handicapped
person." Employers and condominium
boards do not need to grant accommodations in all instances. An employer may
refuse to grant an accommodation if the
proposed accommodation would impose
an "undue hardship" on the employer. In
considering what constitutes an undue
hardship, employers should consider
the following: the nature and cost of the
accommodation; the financial resources
of the employer making the accommodation; the number of employees and the

on the expenses and resources of the
employer; the type of the employer's
operation, including the structure and
functions of the workforce; and the
impact of the accommodation on the
operation of the facility making the accommodation, including the impact on
the ability of other employees to perform
their jobs and the impact on the facility's
ability to conduct business.
Neither the ADA nor G.L. c. 151B
require an employer to accommodate an
individual who poses a direct threat to
his or her own health or safety or to the
health or safety of others. The risk must
be evaluated on a case by case basis.
While the Barbuto case focused on
employee/employer discrimination and
accommodations, much of the decision
is applicable to condominiums. The
important takeaways from the Barbuto
case are: (1) that employers and condominiums may no longer be able to rely
on the illegality of marijuana under federal law to deny a request to use medical
marijuana; and (2) it is critical that
employers and condominium boards
engage in an interactive process with
the disabled employee/resident before
the employer or condominium board
makes decision on the requested accommodation. Of course, the best plan for an
employer or condominium board when
faced with a request for an accommodation is to consult with your attorney.
