Under those circumstances, FEMA has
said that if the local jurisdiction wants
to remove the debris, the agency won't
require prior approval and may approve
federal funding for the work.
"That's not a guarantee," Bauman
says, "but it does provide a template for
persuading local authorities to cooperate with community associations."
The key, she says, is for associations
to develop good working relationships
with local officials. With those relationships in place, Bauman notes, "the
process becomes much easier. Some cities and counties have decided to remove
the debris, regardless of whether FEMA
reimburses them, because they knew
it was the right thing to do." In Hilton
Head, after Hurricane Matthew several
years ago, the town council approved an
ordinance requiring post-storm service
to homeowner associations. "Because
the town has a legal obligation to re-

revise its interpretation of the disaster
aid program, Bauman, says.
Congress is again considering legislation, introduced repeatedly and unsuccessfully, that would explicitly authorize
assistance for homeowner associations.
But in the meantime, she notes, "We've
mobilized our members in Texas and
Florida to contact their Congressional
representatives and their governors and
tell them, 'we need help now.'"
