activity, and commenced an enforcement action to halt this practice.
The marina took the position that
in order to permit this type of use the
declaration would have to be amended
by unanimous vote of the unit owners.
The unit owner (Plaintiff, here) took
the position that because the amendment would only be loosening the
marina use restriction, this was not in
effect a "change", and thus would only
require a majority vote (51 percent) of
the unit owners to approve.
As the declaration did not specifically address the definition of what
was and what was not a change in use,
the matter was put before Judge Stern
via Motion for his interpretation of
RIGL 34-36.1-2.17 (Amendment of
Declaration)-specifically Section (d)
thereof which states that:
"Except to the extent expressly permitted or required by other provisions
of this chapter, (neither applicable
here), no amendment may create or
increase special declarant rights, increase the number of units, change the
boundaries of any unit, the allocated
interests of a unit, or the uses to which
any unit is restricted, in the absence of
unanimous consent of the unit owners."
In court, in what I now refer to as
my "vegetable speech," I argued on
behalf of the association that when a
doctor tells you to change your diet
and eat more vegetables and less fatty
foods, he writes in his report-advised
patient to change his diet. In that case,
it doesn't matter whether the diet is
less restrictive or more restrictive-it's
still a change of diet!
Apparently, Judge Stern agreed
because he held that RIGL 2.17(d)
applied to this contemplated use and
that unanimous approval of the unit
owners would be required to permit
the proposed upweller rafting for the
oyster farm.
