the self-managed board can take steps to
tackle the issue. In some instances, the
common element repair/replacement is
part of a long range plan that includes engaging an engineering firm, determining
funding options and hiring a contractor.
Sometimes, the self-managed board must
inform the unit owner that the problem
they have brought to them is actually a
matter that the unit owner must handle at
their own expense. This result is likely not
to make the unit owner happy but to lead
to an angry outburst of "I pay condo fees!
You should take care of this problem for
me!" or worse.
DON'T MAKE NOISE
Accommodation of unit owner's preferences for restricting noise is often a
challenge leveled at the self-managed
board. The bylaw that safeguards the
quiet enjoyment of one's home does not
necessarily allow unit owners to make

it impossible for the trustees to operate
the self-managed association effectively
and cost-efficiently. Moving the trash
receptacles out for pick up early in the
morning may disturb a resident's sleep
but if the containers are not out at
7:00 a.m. to be picked up by the vendor,
the rubbish and garbage will sit in the
building smelling and attracting vermin
or additional funds will need to be
expended to arrange another pick up.
If winter storms make the sidewalks,
roadways, and parking areas slippery
and dangerous, the snow removal
company must use their equipment to
ensure safe passage for the residents
of the community.

STOP DOING THAT
Living in a multi-family community
often leads to conflicts with respect to
how people conduct their everyday lives.
From the time they rise in the morning

and walk around their unit to when they
get home at night, from the banging of
kitchen cabinets to how they use their
in-home exercise equipment, from the
smells of their cooking to the way they
park their car, from grandchildren bouncing balls on the hardwood floor to the
cigarette smoke coming from inside their
unit, the activities of life can impact unit
owners, pitting neighbor against neighbor.
Unit owners will often demand that the
board take action to make the bothersome
behavior stop. While the condominium
documents may address some of these
issues, they seldom provide regulations
that will resolve all of the behaviors that
annoy some unit owners. Living in close
proximity to others necessarily requires a
certain level of tolerance and acceptance
of the way that other people live. In spite
of what a unit owner may want, the board
of the self-managed association cannot
be expected to control the personal
choices that residents make in everyday
living if they are not violations of the association's bylaws.
Self-managed boards must reflect
clearly on their responsibility to put the
best interests of the association above the
individual agendas of the unit owners.
Trustees must understand that they are
not responsible for the happiness of unit
owners but for the proper operation
of the association and its fiscal wellbeing. Providing the members of the
community with communications and
programs that educate about how the
community works and inform about the
authority and responsibilities of both the
board and owners will help to form more
realistic expectations.
