State and federal restrictions on
evictions and foreclosures have complicated actions against delinquent condominium owners. "The questions are
not so much about the steps preceding
foreclosure," which it seems clear that
associations can pursue, Moriarty says,
but whether associations can or should
proceed with a foreclosure sale if they
get a court judgment is less clear.
Many condominium association
attorneys, including Moriarty, are
convinced that the Massachusetts
foreclosure moratorium, which was still
in place when this article was written,
doesn't apply to condo associations,
"but there are arguments on the other
side," Moriarty notes. And uncertainty
about whether a foreclosure action is
legal could discourage buyers from bidding at a foreclosure sale, "artificially
reducing" the sale price and reducing
the proceeds due the owner after the
delinquency has been satisfied.

A delinquent owner who gets far less
than market value for his/her property
would almost certainly argue that the
foreclosure sale was not the "commercially reasonable" transaction the law
requires, Moriarty says. Because of that
potential cloud, his firm,
like many others, is
proceeding with
collection actions but holding
off on foreclosure sales.
"At some
point, associations will have
no choice - they will have to proceed,"
he agrees. "But for now, we're just sitting on foreclosure judgments."
ENFORCING PANDEMIC
RULES AND PROTOCOLS
Many associations are requiring owners to wear masks and maintain social
distance in common areas, and most

owners have been complying with the
rules. But, as lockdowns have eased,
some are becoming complacent, less
conscientious, and less cooperative.
Communities with lobbies and
reception desks can keep a supply
of masks to offer owners who have
"forgotten" theirs.
"The biggest challenge for
us comes
after hours,
when the
staff has
gone home and
owners congregate in
common areas," Previti says. Friendly
reminders are usually all that is required, but if owners refuse to comply,
"we have to do something." The board
can impose fines and sue non-compliant owners, if necessary, to enforce the
rule. But most prefer to avoid litigation. Previti mentions a better option:
if the city or town itself has a mandate,
