No Raised Taxes on Diesel
ABA's effort to rid taxes on fuel for motorcoaches continues

S. 554 The Motorcoach Enhanced Safety Act of 2009 The bill would add some 15 mandates to the requirements faced by motorcoach operators. Among other mandates the bill requires seat belts for each seat location, new standards for roof crush strength and window glazing, and enhanced driver training. H.R. 4676 The Travel Regional Investment Partnership Act A bill that would provide $50 million worth of matching federal funds for U.S. attractions and destinations to market themselves to prospective tourists. S. 3601 The Oil Independence for a Stronger America Act of 2010 Introduced by Senator Jeff Merkley (D-OR), the legislation aims to reduce the amount of oil used by Americans to the tune of 8 million barrels a day by the year 2030. S. 3663 Clean Energy Jobs and Oil Company Accountability Act of 2010 Introduced by Majority Leader Harry Reid (D-NV), the bill would would address issues in response to the Gulf of Mexico oil spill, create an energy-efficiency retrofit program, provide tax breaks for natural gas vehicles and infrastructure, and boost funding for the Land and Water Conservation Fund.

n July 26, Secretary of Transportation Ray LaHood announced that the Obama Administration will not raise federal fuel taxes to pay for the stalled highway reauthorization bill. While it significant that fuel taxes won’t go up, ABA’s Government Affairs and Policy team is efforting a discontinuation of the motorcoach operator requirement to pay federal taxes on the diesel fuel you purchase for your fleet. Although private motorcoach companies currently receive a partial fuel tax exemption, rail, and heavily subsidized public transit systems are completely exempt from paying federal fuel taxes. ABA believes motorcoach transportation is vital to our transportation network and should be considered equal to or better than publicly funded transportation. If our elected officials want to keep America moving, our industry must achieve a level playing field with rail and public transit systems in the application of diesel fuel taxes. To better understand how that might be possible, here is some background information on federal fuel taxes and how they impact motorcoach operators. The federal government currently levies a 23.4 cent tax on every gallon of diesel fuel purchased at the pump. As a motorcoach operator, you are only obligated to pay 7.3 cents of that tax, realizing a savings of 17 cents on every gallon of fuel you purchase. This is because of the partial fuel tax exemption the industry currently enjoys and ABA fights to maintain. For even average sized operators, this

exemption can result in tens of thousands of dollars in tax credits or rebates. Take, as an example, an operator that has ten coaches in its feet with and an average of 60,000 miles traveled per coach. That company could reasonably expect to use around 100,000 gallons of fuel in a year. Thanks to the partial fuel tax exemption, that company is entitled to a $17,000 tax refund. To receive this refund from the federal government, you simply have to complete a short form from the IRS, and include it with your business income tax filing. Our message to lawmakers is simple: Private motorcoaches provide the exact same benefits as the publicly funded transportation systems and do so at little to the tax payers. In addition our industry serves as a vital link to millions of Americans whether they are commuting to work, traveling for vacation or making the important connection from rural communities to urban centers. We are part of the mass transportation solution and our legislators can not take the valuable services motorcoach operators provide for granted.
