about these and other questions and some surprising answers. The seriousness of the industry’s purpose was indicated by the standing-room-only crowd. A rough count of the people in the room yielded an estimate of 150 bus operators in the morning session and an equal number in the afternoon session. Bus operators in the meeting represented all segments of the motorcoach industry—charter and tour, scheduled service, commuter operators, and airport shuttle providers. The bus operators were able to tell the agency what works best when considering drivers’ HOS. Perhaps even more importantly, operators demonstrated how they have adapted their operations to the present HOS rules and how that has benefited consumers. In sum, the motorcoach industry’s best practices were revealed to the FMCSA staff. As a bonus, operators were able to inform the agency of actions the FMCSA could do to help not only the industry,

but the public as well. What made these sessions so important was the fact that it was the “cream” of the industry imparting what they do in the current HOS environment and how what they do affects bus operations. A brief list of practices noted and the lessons learned includes: The need to stage drivers along a route to ensure that HOS regulations are not violated. The need to turn down charter work when potential customers insist on buses driving routes and to destinations that cannot be done within the HOS. A requirement that the industry and the government inform customers of the HOS and why they are so important. The necessity for drivers and their families to be involved in the drivers’ health and wellness. A fatigued driver is a risk to all, but the answer is not just that the HOS be followed. The drivers’ families must understand that the need for rest must be taken seriously. Rest does

not mean, work on the roof, fix the washer or even play poker with the guys. There must be an emphasis on getting bad operators off the roads. Each reputable bus operator is adversely affected by the bad operators. This means enforcement of the present HOS rules. It will not matter what the HOS are if there are operators who choose to ignore them. Finally, the present HOS rules were favored by the assembled bus operators. But the main issue is not the continuation of the current rules. What the operators at Marketplace 2012 were united behind is the requirement that any changes in the HOS must be based on sound science and significant research. Changes based on “perception” or someone’s idea of what the HOS “should be” will not advance safety in the slightest degree. If FMCSA takes this final lesson to heart the Marketplace 2012 Listening Sessions will have been a great first step. –Clyde Hart
