Advising
International Students
to "Just Say No"
Many international students do not realize
that even "minor" drug possession charges
can cause serious immigration complications.
International student advisers can help provide
vital information in advance of a possible offense.
IN A CULTURE dominated by Judd Apatow movies and increasing liberalization of marijuana

laws, "weed" is as popular as ever on college campuses. But international students should avoid it
like the plague: the smallest joint can spell the end to their American dreams.

A student was charged with simple possession of
marijuana. What is the first thing he or she
should do?
There are two "first things" the student should do: contact
a competent criminal-defense attorney and contact an
immigration lawyer who specializes in the immigration
consequences of criminal conduct. Most criminal-defense
lawyers do not have more than a basic understanding of immigration law. Getting a "good result" from the perspective

of the criminal-defense lawyer can still have terrible immigration consequences. Hire lawyers who know both areas.
The immigration lawyer will take into account the student's immigration situation and propose outcomes that
will eliminate or reduce the immigration consequences of
the marijuana charge. The defense lawyer will act as the
"boots on the ground" to negotiate with the prosecutor
and try to secure one of those outcomes.
Above all, the student must take this very seriously. As
explained in greater detail below, he or she must do whatever possible to avoid ending up with a drug conviction.
So what if the student is convicted of simple
possession? It's a pretty minor crime.
Even the most minor conviction for simple marijuana possession can ruin your student's future in the United States:
n  A student convicted of possessing more than 30 grams
of marijuana, he or she can be placed in removal proceedings and removed/deported from the United States.3
n  The student may be unable to extend his or her immigration status or change to a different immigration status
such as H-1B.4
n  The student will be unable to reenter the United States
after foreign travel without first obtaining a "waiver"

Nearly all students know that simple possession of
marijuana is a federal crime.1 They also know that for
many students first offenses often come with little more
than a "slap on the wrist"-usually community service,
fines, and no jail time.
But many international students have almost no concept of the severe immigration consequences of these
acts. International student advisers should make a point
to inform their students that there can be serious consequences of drug use. What follows are common questions
with answers that will hopefully fill that knowledge gap,
empowering students and international student advisers
with answers to questions about drug use and possession
that often arise far too late.2
