Sweeping New EU Data Protection Regulation
to Impact Education Field
THE GENERAL DATA
PROTECTION REGULATION

(GDPR), which goes into effect on
May 25, 2018, applies new rules to the
management of personal data of all EU
residents. Because of the expansive reach
of the GDPR-the regulations apply to all
companies and organizations that manage
or process personal data belonging to any
EU resident, regardless of the company's
location or the individual's citizenship-
the new rules will likely affect the vast
majority of higher education institutions
around the world, including U.S. institutions that conduct business with EU
countries. Institutions will need to review

their policies on collecting and managing
data from the students, alumni, faculty,
staff, donors, and others with whom they
interact on a daily basis.
For the purposes of this regulation,
"personal data" is defined as "any information related to a natural person or 'Data
Subject', that can be used to directly or
indirectly identify the person...anything
from a name, a photo, an email address,
bank details, posts on social networking websites, medical information, or a
computer IP address." Organizations that
process this type of data must comply with
the rules set forth in the GDPR or face
fines of up to 20 million euros.

Brazil Launches New Funding Scheme
to Support Internationalization of HEIs
THE BRAZILIAN MINISTRY OF EDUCATION has earmarked $90

million for the Program for Institutional Internationalization of the Higher
Education Institutions and Research Institutions in Brazil (CAPES-PrInt), a
new funding scheme to support the country's internationalization efforts. The
program replaces Brazil's previous mobility scheme, Science Without Borders
(SWB), which officially ended in April 2017.
While SWB provided scholarships for more than 100,000 individual
Brazilian students to go abroad, the new program will provide block grants
directly to Brazilian higher education institutions.
The program supports institutions in developing strategic internationalization plans and allows institutions to identify their own priority needs and
develop partnerships with overseas institutions.
The new program will be administered through the Coordination for the
Improvement of Higher Education Personnel (CAPES), a foundation under
the Ministry of Education, and will fund up to 40 projects that are planned
to start in August 2018 and will run for up to four years.

Despite ongoing Brexit negotiations,
the United Kingdom is included in the
GDPR jurisdiction and will be until its formal break from the European Union. PostBrexit, the UK government is expected to
enact similar privacy regulations since the
United Kingdom voted in support of the
GDPR in April 2016.
In addition to data processing requirements, other topics covered by the GDPR
include conditions for consent, breach
notifications, rights to access and erasure
(or the "right to be forgotten"), and data
protection officers.
