ResearchCorner Don’t Reinvent the Wheel: Best Methods for Creating Ordinances in Your County By Michele NeSmith Research and Policy Development Director D The best method to use in creating ordinances in your county is to review existing ordinances adopted by other local governments and then contacting those governments to determine how their ordinance is working. rafting ordinances can be a difficult endeavor, especially if the subject matter is complicated or the concept is new to your county. Trying to put together an ordinance of this nature in a vacuum is often counterproductive and can cost your staff countless hours of research that could be avoided. There are several research methods that can be utilized which can provide quick, precise results without draining your resources. The best method to use in creating ordinances in your county is to review existing ordinances adopted by other local governments and then contacting those governments to determine how their ordinance is working. The fastest and easiest way to review these ordinances is through the online ordinance library provided by the Municipal Code Corporation at www.municode.com. The Municipal Code Corporation provides many services for local governments, including an online library that houses ordinances from more than 1,800 local governments, representing almost every state in the nation. This online library can be used for individual or comparative searches. There is no cost to use the individual ordinance code search, so if you know of other counties (or cities) that have adopted a similar ordinance you can simply pull up their ordinance through the online library. If you do not know of any counties (or cities) that have adopted a similar ordinance, you can use the multiple code search to search all available local ordinances on that topic, however, in order to perform a search of this nature, you must have a subscription. The year subscription for the Municipal Code Corporation is $300. If you are unable to use the multiple code search through the Municipal Code Corporation, it is often helpful to post a question regarding your ordinance on the clerk, manager, or county attorney listserv. These listservs are a very valuable resource to county staff, and the questions posted usually receive a quick response. By becoming a member of these listservs, you can inquire as to whether any other county has the type of ordinance that you wish to adopt and anyone that has such an ordinance will usually respond. In addition to locating those counties with a similar ordinance, you can also get feedback from other county staff on the problems or issues they had in adopting their ordinance. In the event that the Municipal Code Corporation or the listserv did not provide you with the information that you needed, ACCG may be able to assist. The most important aspect of draft ing ordinances is to remember that your county is probably not the first to address this issue.
