Behind the Badge
The "Behind the Badge" series
gives readers an up-close view
of the Game Commission's lawenforcement efforts.
Fictitious names are used.
I was writing information down
when John pulled me to the side and
said, "Mario, that guy we just talked to
on the road is coming over this way; I
think it's Harpy's dad."
I continued collecting information
and when Wily approached, I looked up
at him and let him know I remembered
him from our conversation minutes
earlier.
I asked him why he didn't tell us
about any of this.
He shot back, "Hey, we just got
scared. I didn't want him to get into
trouble."
I told him that, if the deer was killed
by mistake, he or Harpy could have
used their cellphones to call the Game
Commission, or - easier yet - he could
have told John and me about it when
we talked to him.
Then I proceeded to tell him I knew
the deer wasn't killed by mistake.
Wily then started to become a little
arrogant and touted, "Listen, I know a
lot of important people in high places."
"Mr. Sham, I'm only doing my job
and you can do whatever you please,"
I said.
Wily then said, "OK, we'll pay the
$25 for a mistake kill and get this over
with."
I explained that it wasn't quite that
easy now, as they were trying to get an
illegal deer out of the woods, and Harpy
already admitted that he identified the

deer as a 4-point before he shot.
Harpy again added that it was
wounded and he wanted to put it out
of its misery, which I explained is not
legal to do.
Wily then said, "C'mon, give us a
break; we didn't mean to do this."
I allowed Harpy to fill out an affidavit
for a mistake kill, but ultimately
rejected the affidavit and informed the
pair they both would receive citations
for killing a protected deer.
"I told you this wasn't going to work,
Dad!" Harpy said.
Wily stared back at me red-faced
and speechless.
John and I loaded the illegal deer
onto my rack and headed back to
Linesville to get it to a family who'd
requested a deer from me earlier.
Both Harpy and Wily requested a
summary trial.
John and I had just entered the
magistrate's office on the day of the
trail when a security guard approached
us and said the Shams' attorney wanted
to discuss a plea agreement.
The attorney said his two clients
were willing to plead guilty to killing
the deer, and he showed me a letter
Wily written, admitting to his actions
and apologizing for his behavior.
The magistrate accepted their guilty
pleas, and ordered both to pay fines
and costs.
The case serves to show honesty is
the best policy.
If Wily would have admitted to
illegally killing the deer when we
encountered him, only Harpy would
have ended up with a citation.
In the end, however, in attempt to
cover up their deed they made it worse.
