Calorie Counting
The Food and Drug Administration is finalizing new rules that will require restaurants and foodservice operations with 20 or more locations under the same trade name (likely to include bakery and pastry shop chains) to post the calorie content of all standard menu items at point of sale. This means that chain operators can’t simply list the calorie content of standard menu items on their websites. Also mandatory under the FDA’s proposed labeling rules is a succinct statement concerning suggested daily caloric content. Further, consumers must be provided with a means to obtain more information, such as on a website. The new labeling law could be published by FDA by late this year and then implemented within the following six months to a year. Preparation for the rule is key, points out Cicely Simpson, senior director of government affairs for Dunkin’ Brands. She advises chain operators to read through the entire lengthy proposal and not overlook anything. “You need a plan for implementation,” she says. Simpson recommends a thorough examination of all the scenarios that can affect your company, and understand how you are going to handle labeling — whether it be on menu boards, fliers or brochures, or at a kiosk. “It has to be at point of sale,” she says. “Menu boards are pretty precious real estate. It’s important to know how you are going to do this in a readable and easy-tounderstand way. There’s going to be quite a significant amount of education effort involved in all of this.” Customers are attempting to make more of their calories count for better overall health, with 55% of shoppers switching to whole grain bread, 33% showing an interest in protein on the label (up 10 points since 2009), and 30% switching to Greek yogurt (up nine points vs. 2011), according to the new Shopping for Health 2012 annual study released this summer by FMI and Prevention magazine. “Having a plan for implementation is crucial,” Simpson says. Further, the 2010 Dietary Guidelines released in early 2011 are prompting consumers to balance calorie intake with calorie “You have to be able to pull the trigger immediately once the rule is final.” The law preempts existing municipal or state laws that vary in requirements. Those laws started cropping up in 2006, when New York City became the first government entity to put a nutrition labeling law in place. Such laws present special challenges to companies that operate regionally or nationally. Roehl says the new law won’t be enforced until at least six months after the publishing of its final rules, which is unlikely to occur before November, possibly later. The NRA has been working with the FDA on the proposal. “We’re hopeful we will see more time than six months, but we’re advising operators to be prepared to implement six months after the final regulations are released,” Roehl says. He points out that menus are the primary means by which restaurants communicate with customers. By contrast, the Food Marketing Institute explains that, under the Nutrition Labeling and Education Act and other food labeling laws, more than 95% of foods sold in grocery stores already typically provide nutrition information. That is why it appears likely that supermarkets will be exempt from the new labeling laws that will require listing calories at point of sale. The FDA is still determining what similar retail food establishments would be covered by the law. “Our theory is it should fit the same definition as restaurants,” including convenience stores and grocery stores, says Dan Roehl, public affairs specialist for the National Restaurant Association. Under the FDA rule, caloric content of menu items along with the recommended daily caloric intake will be listed on menus or menu boards. Also, a statement that additional nutritional information is available upon request will be included on the menus. Exempt items are specials, condiments, limited-time offers, custom orders and test-market items. usage, as well as to reduce refined grains and salt, and to eat more vegetables.
