Judge approves injunction
against New Jersey bakery
WASHINGTON — Judge Dennis M.
Cavanaugh of the U.S. District Court
for the District of New Jersey has approved a consent decree of permanent
injunction against Butterfly Bakery,
Inc., Clifton, N.J., and its president,
Brenda Isaac, for unlawfully distributing misbranded food products, the
Food and Drug Administration reported March 13.
The consent decree restrains Butterfly Bakery and Ms. Isaac from
processing and distributing food until the company complies with the
Federal Food, Drug and Cosmetic
Act and applicable regulations. The
F.D.A., under the consent decree,
may assess damages against Butterfly

Bakery for any future violations of
the law or consent decree.
According to the F.D.A., the F.D.A.
and state officials tested Butterfly Bakery samples, such as muffins and snack
cakes, over a period of years. Laboratory
analysis revealed false and misleading
labels. For example, products labeled
as sugar-free contained sugar, certain
products contained as much as three
times the amount of labeled/declared
sugar, two times the amount of labeled/
declared fat and two times the amount
of labeled/declared saturated fat.
“This injunction demonstrates that
the F.D.A. will seek enforcement action against companies that mislead
consumers on the products they

Grain Millers expanding ﬂax business,
partnering with Pizzeys
EDEN PRAIRIE, MINN. — Grain Millers,
Inc., which offers a wide array of ingredients in the grain, dairy, specialty and feed
categories, is stepping up its presence in
the flax business with the launch of a new
product, the opening of a new production
site and a partnership with flax industry
veterans Glenn and Linda Pizzey.
After more than a year in development,
Grain Millers is launching SafeFlax flaxseed products. The new items undergo
a proprietary heat-stabilization and pasteurization treatment developed by Grain
Millers, the company said. The SafeFlax
process was created specifically to mitigate the risk of contamination while minimizing stress on the flax product, a seed
notoriously difficult to process.
“Grain Millers’ advanced understanding of flax processing was one of the
things that interested us most in this

partnership,” said Linda Pizzey, who along
with Glenn Pizzey has joined Grain Millers
to help with all aspects of Grain Millers’
existing flax business, including processing, product development and technical

services. “The SafeFlax process allows us
to optimize the processing parameters for
different products. Without this feature,
you might eliminate pathogens, but you
won’t adequately maintain the stability of
the natural lipids and other nutritional and
functional components in flax.”
The SafeFlax line includes SafeBake
and SafeBev, solutions that have been
designed for the baking, cereal and beverage markets. SafeFlax products also
will be used in a variety of mixes that

Kashi ofﬁces moving to Michigan
BATTLE CREEK, MICH. — Kashi, based
in La Jolla, Calif., since the company’s
founding in 1984, will move to the Kellogg
Co. headquarters in Battle Creek, said Kris
Charles, a company spokesperson for Kellogg. With the move, Kashi will be best
positioned for continued growth, she said.
Kellogg eliminated 14 Kashi jobs and
offered 14 other Kashi employees the opportunity to relocate to Battle Creek, Ms.
Charles said.

the Kashi team and are working with

impacted employees to consider alternative roles across Kellogg Co., where possible,” she said.
Kashi joined the Kellogg brand portfolio
in 2000. Kellogg’s Morning Foods &
Kashi business, which is comprised of
U.S. cereal, Kashi, Health & Wellness and
Pop-Tarts toaster pastries, had fiscal-year
2012 operating profit of $595 million,
which was down from $611 million in
fiscal year 2011. Fiscal-year sales rose to
$3,707 million from $3,611 million.

Butterfly Bakery meets F.D.A. regulations, it will no longer be able to process or distribute their products.”
On its Facebook page, Butterfly Bakery said it voluntarily had entered into a
consent decree. The company said since
receiving an F.D.A. letter dated May
31, 2011, it has been working with the
F.D.A. and a team of technical and regulatory experts to improve the bakery’s
processes and ensure compliance with
all Butterfly Bakery products. The allegations involved 3 out of the company’s
45 items, according to Butterfly Bakery.
“We are confident that our product
claims are true and we are continuing
operations to satisfy our customer’s
needs,” Butterfly Bakery said on its

Grain Millers will manufacture SafeFlax
in its Marion, Ind., facility and at a new
site in Angusville, Man. The locations will
join the existing Grain Millers flax facility
in Newton, Wis., to create one of the largest footprints of any food flax processor in
the world, the company said.
“Having three facilities capable of making whole and milled flaxseed products
will be a critical benefit to our customers,”
said Steve Eilertson, president of Grain
Millers. “It not only ensures our customers
will benefit from the most efficient distribution, but also guarantees they will never
face the production disruptions that have
become commonplace in the flax industry.”
The sites are expected to be fully operational by May.
Glenn and Linda Pizzey previously
were associated with Pizzey’s Milling,
which produced and marketed nutritional ingredients that primarily originated
from flaxseed. Glanbia P.L.C. acquired
Pizzey’s Milling in 2007. MBN

president of Kellogg’s U.S. Frozen Foods,
in a Feb. 5 earnings conference call.
“It’s a brand that consumers know and
trust, and we’ve added innovations to
our existing pizza and entree businesses,” he said. “In 2012, we launched Kashi
steamed meals, a convenient and easy
way to get delicious, natural meals.”
In cereal, however, Kellogg faces challenges in its Kashi business, said John
Bryant, president and chief executive officer of Kellogg, in the Feb. 5 call.
“We’re not happy with the performance of our Kashi business,” he said. MBN
