Incentive-based inspection

T

he Food Safety and Inspection Service's interim final rule to reduce the incidence
of Listeria monocytogenes represents a positive shift in the agency's approach to
inspecting the industry. I hope this is only the beginning.
Rather than rely on F.S.I.S.'s traditional role as enforcement cop, agency administrators
crafted an interim rule that provides manufacturers of ready-to-eat meat and poultry products with an incentive-based inspection program. The rule gives processors three options,
depending on whether they employ post-lethality treatments, antimicrobial agents or processes, or sanitation measures only. The level of inspection verification testing and oversight
that takes place in an R.T.E. facility depends on the alternative chosen and the control measures employed by each processor.
The results are promising. A report issued by F.S.I.S. earlier this month indicates that the
overall safety of R.T.E. products has improved in response to the Listeria interim final rule
because companies have strengthened their control procedures, increased testing and taken additional steps to eliminate the pathogen.
"Under the Listeria rule, R.T.E. products are safer and public health is being better protected," says Dr. Elsa Murano, outgoing under secretary for food safety. "If progress continues at the current rate, we should achieve the Healthy People 2010 goal of lowering the incidence of listeriosis to 0.25 cases per 100,000 people."
The report found that many plants have made significant improvements to address Lm,
such as adding antimicrobial ingredients to their product formulations to inhibit growth
and installing a post-processing treatment step to eliminate the pathogen. In addition,
the report found that companies have either initiated or greatly increased their testing for
Listeria or Listeria-like organisms on surfaces that come in contact with products after
cooking. The testing data is available to F.S.I.S. inspection personnel as a result of the interim final rule and are used to determine the effectiveness of sanitation and other control measures.
The financial chasm that exists between the industry's largest company, Tyson Foods,
Inc., Springdale, Ark., and the smallest firms widens with the release of every quarterly financial report. The only way F.S.I.S. can effectively regulate the industry without causing additional consolidation is to develop additional incentive-based rules.
While companies like Tyson Foods can afford to make immediate investments in post-lethality technologies and inhibitory ingredients, small companies must weigh their options.
That is what makes incentive-based regulations so important. Without them, small firms are
faced with two choices - Exit a potentially lucrative market or make significant capital investments that can drive them to the brink of insolvency.
Incentive-based regulations like the Listeria interim rule provide a third option. They allow
company managers to develop effective sanitation programs to remain in compliance and
plan for future capital investments.
Looking at the results of the Listeria interim rule and its impact on the industry, it makes
me wonder what would have happened if F.S.I.S. had developed an incentive-based rule regarding E. coli O157:H7 instead of declaring it an adulterant and telling the industry to "deal
with it?" How many companies would still be in business? Would there have been so much
consolidation among mid-size beef processors?
We'll never know the answers to those questions, but we do now know the effectiveness
an incentive-based rule can have. The concept probably won't work in every regulatory situation, but it can at least be an option.
The deadline for comments regarding the Listeria interim rule has been extended to Jan.
31, 2005. This isn't an issue that only R.T.E. manufacturers and their representative trade
associations should weigh in on. This rule can have a positive effect on the rest of the industry and F.S.I.S. should be encouraged to develop similar incentive-based regulations
throughout the industry.
