The recent publicity surrounding
professional athletes using illegal,
performance enhancing drugs serves
as a reminder of the prevalence of drug
and alcohol use in today's society. The
news also iterates the importance of an
employer's role in maintaining a drugand alcohol-free workplace.
The costs associated with drug- and
alcohol-testing programs are minimal
considering the potential exposure employers may face. Prior to implementing or revising a testing policy,
both federal and applicable state
laws should be reviewed. Although no federal laws regulate
drug testing in the private sector,
Congress enacted the Drug-Free
Workplace Act in 1988, which
requires federal contractors and
grantees to maintain a drug-free
workplace or risk losing federal
funding. Also, federal regulations
issued by the U.S. Dept. of Transportation require certain private
sector employers to implement
drug-free programs.
These programs apply to employees
in safety-sensitive positions, such as
truck drivers, airplane crews, air traffic
controllers, commercial vessel crews,
pipeline workers and train crews. Moreover, because drug testing of applicants
and current employees is a mandatory
subject of collective bargaining, employers with a unionized workforce should
not unilaterally implement a drug and
alcohol-testing program. Currently,
more than one-third of the states have
enacted statutes regulating drug and
alcohol testing. The scope and detail of
these statutes varies widely.
An employer's drug and alcohol testing policy should be clearly stated in
writing and distributed to every employee. Also, as with any employee handbook, a separate acknowledgment form
should be signed by each employee stat58
