The ruling came in a challenge to the recess appointments ﬁled by the Coalition for a Democratic Workplace (CDW), which is supported in part by the Snack Food Association. The court struck down the recess appointments on two grounds. First, it pointed out that the appointments were not made during an intersession recess. Intersession recesses occur between sessions of Congress, and the court found the recess appointment clause only allows intersession recess appointments.
