IN MEMORIAM
Robert "Bob" Foy,
former chair of the
National Moving and
Storage Association
(NMSA) and president of the California
FOY
Moving and Storage
Association (CMSA), passed away
June 9. He was 80.
A California native, Foy was born in
San Francisco, raised in Palo Alto and
became a Stockton resident after graduating from San José State University
and serving in the U.S. Army.

In addition to NMSA and CMSA,
Foy served as chairman of the
California Water Service Co. board
of directors for 16 years. He was
also president and CEO of Pacific
Storage Co. from 1977 until his
retirement in 1995.
As a strong player in the
Stockton community, Foy held
leadership positions in many local
organizations, including president
or chairman of United Way of
San Joaquin County, the Greater
Stockton Chamber of Commerce,
the Stockton Port District board of
commissioners and the St. Joseph's

Medical Center board
of directors.
In 2009, Foy was named
Stocktonian of the Year, at which
time he said, "There's a common
thread that runs through all those
organizations: the people who are
involved, their fondness and the
common bond of people wanting to
help out their home community of
Stockton, California."
Foy is survived by his wife, Barbara;
two sons, Matthew and Peter, and
their wives, Siobhan and Christine;
and four grandchildren, Cate, Jack,
Declan and Ashley.

States Enact New Laws Affecting HHG Movers
Across the country, new state laws
have been passed to tighten and loosen
regulations on household goods
(HHG) movers, as well as to punish
rogue operators.

In Arizona, a new law addresses
concerns about "hostage loads,"
prohibiting moving companies
from holding in-state customers'
possessions over a payment dispute.
Essentially, movers will still need to
make delivery even if the customer
refuses to pay.
Backed by Gov. Doug Ducey, the
law protects consumers moving within
Arizona; however, moves across state
lines are still governed by federal law.
"Customers don't need the added
worry of having to deal with unscrupulous movers taking advantage of
them," Ducey said. "This legislation
rightly puts an end to 'hostage loads'
and ensures all fees and costs are
disclosed from the get-go."

If a mover refuses to deliver and
unload household goods, this new law
allows police to take possession of the
goods. On the flip side, after the goods
are unloaded, moving companies will
now be authorized to pursue collection
of any unpaid amounts on the contract.
Louisiana

Louisiana lawmakers passed a bill that
requires HHG moving companies to
be open for business and staffed during
regular business hours. Carriers that
fail to maintain a permanent establishment in the state could have their
operations suspended or closed. These
changes take effect Jan. 1.
Pennsylvania

Pennsylvania is considering legislation that would boost penalties for
rogue operators.
Currently, state law requires HHG
movers to register and get a permit
with the Public Utility Commission,
maintain workers' compensation

coverage, pay taxable wages and carry
sufficient insurance for goods moved.
Violators are subject to a $1,000 fine.
The new legislation would apply
criminal penalties to HHG movers that
fail to adhere to the existing state law.
Offenders would face $5,000 fines,
a third-degree misdemeanor charge,
and suspension of registration and/
or confiscation and impoundment of
the vehicle used in the illegal move,
with subsequent offenses resulting in
$10,000 fines.
West Virginia

HHG carriers in West Virginia are
now exempt from the jurisdiction of
the Public Service Commission. In
addition, the law eliminates tedious
regulatory procedures, including the
certificate-of-need requirement for
intrastate operations, which previously
made it very difficult to start a new
moving business. As a result, moving
startups are no longer subject to
approval by existing HHG companies. n
