AMSA, Worldwide ERC® Fight
for Moving Expense Deduction

MSA and Worldwide
ERC ® have submitted comments to the
Senate Committee on
Finance, advocating to preserve the
Moving Expense Deduction in any
upcoming tax reform efforts. First
established in 1964, the deduction
encourages more people to move
and reduces the effective after-tax
cost of using a professional mover

for both individual moves and
employer-paid moves.
Many of the tax reform proposals
being considered, including President
Donald Trump's proposal, reduce
overall tax rates by eliminating
deductions such as the Moving
Expense Deduction. Eliminating this
benefit, though, could ultimately
hurt middle-class families, as they
will be less likely to afford relocation

expenses and reluctant to move
where new job opportunities exist.
Additionally, any tax savings incurred
by eliminating the deduction will
result in added costs to government
and private employers who pay for
relocation expenses.
AMSA and Worldwide ERC® will
continue to monitor the status of the
deduction in Congress and spread the
word to their members.

Congress Works to Block State-Level Regulations

NOVEMBER | DECEMBER 2017

Once again, Congress is considering
legislation that would stop state-level
efforts to determine driver pay reforms
and hours-of-service restrictions.
Known as the Denham Amendment,
the legislation was first introduced by
Rep. Jeff Denham (R-Calif.) in 2015,
and it would reinstate federal authority
over hours-of-service regulations and
the trucking industry's standard permile driver pay model.
The Denham provisions seek
to block states from enacting and

enforcing laws that would impede
federal hours-of-service regulations.
This includes meal and rest break
requirements in California.
While the American Trucking
Associations and the Western States
Trucking Association are among the
industry's top lobbyists in favor of
passing the Denham Amendment,
this is the third consecutive year that
the amendment is up for consideration. In 2015, an attempt was made
to attach the language to the FAST

Act highway bill, and last year the
Denham language was considered
as part of the Federal Aviation
Administration (FAA) reauthorization packages, but both of those
efforts failed.
Meanwhile, opponents of the
Denham Amendment, including the
Owner-Operator Independent Drivers
Association, claim it would stall efforts
to promote more fair-driver compensation packages.

House Bill Would Delay ELD Mandate for 2 Years
A new House bill, the ELD Extension
Act of 2017, proposes to delay the
compliance date of the federal government's electronic logging device (ELD)
mandate by two years, to December
2019. Enacting the bill would give
carriers additional time to adopt ELDs.
This legislation, introduced
by Rep. Brian Babin (R-Texas),
has been referred to the House
Transportation and Infrastructure

Committee. In addition, a House
panel has recommended that the
Department of Transportation study
whether a "full or targeted delay"
of the mandate is needed. Since
the outcome of this legislation is
uncertain, it's best to plan to be in
compliance by Dec. 18, 2017.
In the meantime, the Federal
Motor Carrier Safety Administration
(FMCSA) has introduced an online

tool that allows ELD manufacturers
to test whether their records of duty
status (RODS) files will transfer
properly to enforcement officers
during roadside inspections. The
agency's ELD File Validator is
not required for manufacturers to
self-certify, but the FMCSA encourages manufacturers to use the tool
"to help the self-certification process
go as smoothly as possible."
