Several decades ago, when judicial foreclosure was the only option to legally recover inventory from accounts that had skipped or been unwilling to pay, resort operators were caught between the proverbial rock and a hard place. Mattoni says, "In the ongoing effort to recover delinquent inventory, ARDA has successfully lobbied several states to adopt legislation that provides for non-judicial foreclosure. This process saves a substantial amount of money and time while resolving all the title difficulties the associations face. Bankruptcy, probate, divorce, and lost owners are all resolved with this process. If an association cannot resolve a delinquent file through collection or a deed in lieu of foreclosure, this process is the best way to recover the deed." However, even with non-judicial foreclosure legislation lessening the burden, there are still lawyer fees to be incurred and hoops to jump through. "Unfortunately, in many instances, there are still some attorneys who either don't offer this foreclosure service or don't transfer the economic savings to the client," he adds. "However, there are companies and firms out there that do provide this in an efficient and affordable way." 1 FINDING BUYERS Obviously, regaining nonperforming weeks is only the beginning. Kogelman likes to work in tandem with resorts to help owners sell their weeks when needed. "We understand that managers have enough on their schedules just to keep their resorts operational," he says, "but there also should be a plan in place that can create a pathway to draw new owners to their resort. Using the experience of a vetted, professional company dedicated to the resale sector can be a good option, allowing resorts to protect their owners from unscrupulous businesses without taking staff away from their core competencies." Sister companies not shying away from addressing the topic of resales are Vacation Resorts International and Trading Places International (VRI/TPI). According to Senior Vice President, Corporate and Business Development Jan Samson, they have fine-tuned a strategy that utilizes a number of tactics, including helping several of the resorts they manage to set up a viable sales operation for themselves. "VRI and TPI have negotiated regionspecific broker agreements with experienced timeshare sales entrepreneurs who understand the process, the industry, and who function as independent sales outlets," she says. "At some resorts, our resort manager is also our sales person, which creates a stronger relationship with owners. They are then managing to the expectations for which they sold. This will not work for every resort; however, where it is used, it has proven to be extremely effective."
