New Administration, New
Regulatory Challenges

A

s the February Issue of Compoundings goes to press, it's week one of the
Biden presidency, and the direction is clear.
Regardless of where you stand politically, it's critical to stay informed
about the regulatory challenges that lie ahead for our industry.
The new administration wasted no time unraveling some of the regulatory relief
businesses relied upon during the previous four years. It's no surprise that fossil fuels
are in the crosshairs, with President Joe Biden immediately revoking the Keystone XL
pipeline permit and oil and gas leasing in Alaska's Arctic National Wildlife Refuge. The
president also issued a 60-day freeze on new leases on federal lands, as well as permitting, accounting for 22% of U.S. oil production and 12% of natural gas. In another
immediate action, the president took steps to rejoin the Paris Climate Accord.
As an industry, we should also anticipate more restrictive policy with respect
to fuel efficiency. Under the Trump administration, fuel efficiency standards were
more conservative, as shown when the administration relaxed the Obama-era
standards. It's expected that the Biden team will quickly revert to the Obama
regulations, which mandated an average fuel efficiency of 54.5 miles per gallon for
passenger cars and trucks by model year 2025. As the fuel efficiency mandate kicks
in, it could bring about a need for additional lubricant specifications. This makes
the move to improve the process of specification development more urgent.
For those on the metalworking side, as you know, the Environmental Protection
Agency continues its implementation of the 2016 Toxic Substances Control Act.
The agency is in the midst of its evaluation of existing chemicals. In considering
the question of " reasonable risk, " it's highly likely that new administration officials
will be inclined to move toward more regulation of allowable uses of chemicals
identified in higher-risk categories.
All lubricant manufacturers should brace themselves when it comes to labor issues.
Biden's pick for labor secretary, Boston Mayor Marty Walsh, is a longtime union
member who enjoys strong support from AFL-CIO President Richard Trumka. One
of the first Occupational Safety and Health Administration actions will be to formalize
the Centers for Disease Control and Prevention COVID-19 guidelines by issuing
regulations and stepping up enforcement. ILMA will be vigilant on this front and will
continue to provide guidance and information to members.
As I think about the next four years, I can't help but recall the end of the final
presidential debate when Biden admitted his desire to move away from fossil
fuels. Certainly, this will result in more " green " subsidies and regulations, with a
stepped-up transition to electric vehicles. Lubricants manufacturers can expect that
PCMO volumes will decline at a faster rate than previously thought. California
will continue its battle targeting the internal combustion engine unchecked by the
federal government.
ILMA will continue to weigh in with the administration when appropriate.
