Beware: OSHA's Proposed
HazCom Update

was going to press, ILMA
was finalizing comments to
the Occupational Safety and Health
Administration (OSHA) on its Feb.
16 notice of proposed rulemaking
(NPRM) to amend the Hazard Communication
Standard (HCS). The
NPRM is the first proposed update
of the HCS since 2012. OSHA said
that its NPRM, if finalized, would
for every affected industry " provide
either cost savings, or the costs would
be less than 1% of [a business's]
revenues or 10% of profits. " While
the agency's deregulatory claim should
be welcome news to ILMA members,
the Association decided to dig deeper
into the NPRM, in part because
OSHA commented in the preamble
to the 2012 HCS changes that the
lubricants industry would author 40%
of the new safety data sheets (SDSs)
and would incur roughly 20% of
the overall compliance costs. Small,
incremental compliance cost increases,
thus, could have significant effects for
ILMA members.
While the NPRM generally would
align OSHA's HCS with Revision 7
of the Globally Harmonized System
of Classification and Labeling of
Chemicals (currently at Revision
3), the agency adds some proposed
amendments that are intended to
incorporate provisions from previously
issued letters of interpretation (LOI)
into the actual text of the HCS. In my
opinion, one of these LOI incorporations
into the HCS, if promulgated,

could force ILMA members and other
manufacturers to update the SDS and
container label for every product they
make, as well as revise their written
HCS programs and training. It is not a
deregulatory change, and, if finalized, it
will impose significant compliance costs
on manufacturers and will expose them
to substantial tort liability. Is OSHA
trying to get the nose of the camel into
the tent? Let's take a look, and you can
decide for yourself whether the agency
is making a significant expansion, not
deregulation, of the HCS.
Hazard classification obligations
under the HCS are set forth in 29
C.F.R. Section 1910.1200(d)(1) and
Table D.1. OSHA is proposing adding
the following italicized language:
(d)(1) Chemical manufacturers and
importers shall evaluate chemicals produced
in their workplaces or imported
by them to classify the chemicals in
accordance with this section. For each
chemical, the chemical manufacturer
or importer shall determine the hazard
classes, and where appropriate, the
category of each class that apply to
