Are You Ready for the
New Prop 65 Warnings?

e have had member
inquiries about the
significant amendments to
California's Proposition 65 (Prop 65)
right-to-know program that take effect
Aug. 30, 2018. The state's Office of
Environmental Health Hazard Assessment (OEHHA) has changed what
companies are required to put on their
warnings to enjoy "safe harbor" protection from potential legal challenges,
including from bounty hunters.
Briefly, OEHHA's amendments
include the addition of a pictogram,
listing a Prop 65 website, naming at
least one listed chemical (except for
on-product warnings), certain font
size requirements and revisions to the
actual warning language. OEHHA
believes its changes to Prop 65
warnings will improve compliance,
reduce litigation and provide more
meaningful warnings to consumers.
The amendments cover products
manufactured after Aug. 30, 2018.
As a reminder, the Prop 65 program, which is over 30 years old,
requires businesses to provide "clear
and reasonable" warnings to individuals in California before "knowingly
and intentionally" exposing them to a
chemical "known to the state to cause
cancer or reproductive toxicity." The
Prop 65 regulations prescribe what
constitutes a "clear and reasonable"
warning. Violations can be as much
as $2,500 per day, and private citizens
are permitted to enforce the statute.
Businesses often settle private
Prop 65 lawsuits over whether the

warnings they provided were "clear
and reasonable."
While businesses are not required to
use the Prop 65 safe harbor language
for their warnings, the warnings will
be deemed "clear and reasonable"
under the law if OEHHA's "directions"
are followed. The amended Prop 65
regulations set forth the new safe
harbor warning language for consumer
products and environmental and
occupational exposures, and they specifically address certain products and
chemicals, including petroleum. ILMA
