Those detailed notes made during the
inspection should include all remarks
and questions asked by the inspector
and any employees interviewed by the
inspector. I recommend caution when
explaining the facility's operations.
There is no need to try to impress the
inspector. Be polite, but restrained.
Inspectors will almost always take
photographs of the facility and the
site. If the representative does not
take duplicate photographs, request
copies of the inspector's photographs.
If there is a question as to whether the
inspector photographed materials or
processes that are protected by trade
secret or a confidentiality agreement,
ask that the photos be treated as confidential business information.
It is always in the company's best
interests to ask for a split sample. This

will not only allow the company to
compare results, but if the company's
sample is out of compliance, the company can begin any necessary corrective
work pre-emptively and reduce potential penalties. Because enforcement
action is often based upon the samples,
and because of sampling variability,
record the sampling procedure and
equipment used by the inspector.
The important factors to remember
in any document inspection are: 1)
Show the inspector only those documents or records that he or she is legally
entitled to see; 2) always retain the
original documents, unless seized or
subpoenaed; and 3) ask that all appropriate documents be kept confidential.
Typically, if a claim of confidentiality is
not asserted, it is waived. Assume that
nonconfidential information that is

obtained through an inspection may be
disclosed to the public.
An inspection may involve inspector
misconduct. On occasion, an inspector
will exceed the limits of his or her
authority, because of zeal or for other
reasons specific to the inspector. There
are remedies for such occurrences, but
recognize that the supervisor will tend
to support the inspector unless the facts
clearly demonstrate misconduct.
At the conclusion of the inspection,
request an exit conference with the
inspector. This will serve a number
of purposes, including continued
dialogue with the inspector. Ask the
inspector to disclose any adverse
findings and always request a copy of
the final inspection report issued by
the inspector or agency.
The exit conference provides a view
into what areas of the facility the
inspector is most concerned with and,
often, what particular areas he will
look for in future inspections. Ask
the inspector for any suggestions or
recommendations for improvements at
the facility.
After the inspector leaves, evaluate
the results and prepare to address any
necessary corrective or remedial actions.
A facility inspection facility need not be
a traumatic event. A little prior planning can help minimize its impact.
