Marijuana in the
Workplace

A

t last month's Annual Meeting,
a number of ILMA members
told me about their ongoing
issues with attracting and retaining
workers. One member pulled me aside
and asked me about how to handle a
recently hired employee who presented
him with a medical marijuana card.
Logic suggests that the number of
workers using marijuana has jumped
with 30 states and the District of
Columbia now allowing marijuana
use in some form, and eight states and
the District of Columbia permitting
its recreational use. The widespread
availability of recreational marijuana
should prompt companies without
more to review their policies on
drug-free workplaces, impairment and
drug testing. Employers also need to
be aware that laws regarding medical
cannabis are continuing to evolve with
more and more court decisions. Let me
try to cut through some of the haze.
Conflicts between federal and state
attitudes on marijuana also add to the
confusion for employers. Although
many states have decriminalized or
legalized marijuana, its use remains
illegal at the federal level. President
Barack Obama's administration,
through the so-called "Cole Memo,"
gave federal prosecutors permission
to focus their resources on preventing
marijuana sales to minors and targeting cartels instead of prosecuting adult
marijuana use. The Trump administration, however, has rescinded the
Cole Memo, calling the policy shift a
"return to the rule of law."

Most state marijuana laws do not
provide on-the-job protections for
workers' marijuana use, even for
medicinal purposes. Employers do
not have to allow for on-duty use
or impairment, even by registered
medical marijuana users. For example,
many pro-marijuana advocates cite
a recent Massachusetts case in which
the state's Supreme Court ruled that
marijuana used for medicinal purposes
is just as lawful as other medications
used by employees. However, the
Massachusetts case involved an

employee's medical marijuana use offduty, outside of the workplace, with
no impairment while she was working.
Further, the employee did not hold a
safety-sensitive position.
Employers can still maintain
zero-tolerance, drug-free workplace
policies, but it is going to take some
review and possible clarification of
those policies to account for legal cannabis use. Employees can and should
be reminded that they cannot possess,
use, sell or work under the influence of
marijuana or cannabis products (e.g.,
