Iran and Nicaragua at Year's End: US
Sanctions Update

A
s the year comes to a close, sanctions continue to
grow as the United States continues its efforts to
deter undesirable behavior. On Nov. 5, the final
round of sanctions concerning Iran became fully effective.
On Nov. 27, a new executive order was issued against a
broad category of Nicaraguan leaders and their property and
business interests, adding substantial complication and risk
associated with doing business in the region. For those
companies relying upon or looking to add export markets,
the need for vigilance has never been greater.
IRAN
In a nutshell, the entire program of U.S. sanctions against
Iran is now back in place. All wind-down periods concerning commercial interests and open contracts have ended.
The general licenses that were issued have been rescinded,
and anyone holding a specific export license that permits
any activity with Iran, directly or indirectly, must carefully

revisit the validity of that license. In most situations, a new
license must be sought, and will likely be denied. The overall
purpose, and the net effect, are to prevent U.S. persons from
engaging in activity with Iran or Iranian interests.
As mentioned in previous International Insight columns,
the most salient and risk-laden aspect of the sanctions are
rooted in the secondary activity that might occur with
your product through a non-Iranian customer (such as a
distributor). Simply stated, the conduct of your non-Iranian
customer relative to Iran or Iranian interests can be deemed
to be your conduct as a U.S. exporter.
NICARAGUA
In a more surprising move on Nov. 27, President Donald
Trump issued a new executive order blocking all property and
interests in property of a broad category of people in Nicaragua,
making it unlawful for U.S. persons to engage commercially
with them. The category of applicable people include:
