then you have to identify the API
standard on the label in some fashion."
This could be included in the
donut, or it could be placed elsewhere
on the bottle, said Ferrick. "From
our perspective, our focus is, quite
frankly, squarely on how the starburst
is depicted, is there a license for it
and how the donut is depicted." In
addition, though, he said, in order to
meet state requirements in the 25 states
that follow HB130, manufacturers also
need to include brand viscosity grade,
SAE viscosity grade and performance
levels - that's true whether labeling a
gallon drum or a quart bottle.
Mandates and labeling can create a
complex environment for manufacturers, especially those that operate
in multiple states and internationally.
But the situation becomes even more
complex when we bring the "reasonable
consumer" into the picture.

As the Dollar General class-action case
illustrates, when it comes to interpreting
a label, reasonable minds can, and clearly
do, differ.
"One of the arguments that defense
is making is that Dollar General is
putting appropriate caution statements,
statements required by Handbook 130,
on the back of their container labels so
we didn't violate the law," said Leiter.

now for a couple of years through
the National Conference on Weights
and Measures (NCWM) - adopted
language in Handbook 130 that's published by NIST." These requirements
related to labeling in states where the
handbook has been adopted, Ferrick
noted that "just because it's published
by NIST doesn't mean it's law -
states have to adopt it." Currently, he
said, about 25 states follow HB130,
at least as far as engine oil identification and labeling is concerned.
"What that basically means is if you're
labeling engine oils that meet a current
standard, the label must in some way
provide brand name viscosity, SAE
viscosity and performance level, or a
standard that the oil meets." Consequently, he said, "if you're making an
oil that meets the current API standard,

"But plaintiffs are saying, well, first you
hid that statement within a lot of other
verbiage. So, there's an argument in
terms of what a reasonable consumer
might infer from the front label without looking at the back."
Leiter offered an example that can
illustrate the conundrum that consumers, and regulators, may find themselves
in. "Should a reasonable consumer have
to look at the back panel of a product
to determine whether the representations on the front panel are accurate?"
The question becomes more complex
when considering that graphics and
images, and not just words, are all part
of those disclosures.
He used an example of consumers
visiting various retail locations around
the country and finding oils that are
labeled as API SA oil not intended
for use in vehicles built after 1930.
That cautionary information might
be on the back of the product but, if
the front of the product has an image
of a modern vehicle, should that
create legal liability? Leiter said he
doesn't have the answer: "It's probably
something that courts would end up
deciding." But it's basically the same
issue with which Dollar General is
currently grappling.
From both a regulatory standpoint
and a reasonable consumer standpoint,
lubricant manufacturers face challenges
