* Intentionally added ingredients
(either with a functional or technical effect) contained in the final
product that are included on any
of the 22 designated lists;
* Intentionally added ingredients
which are not confidential business information;
* The company's toll-free telephone
number and website address;
* All products manufactured before
the compliance deadline, but sold
after the deadline, must prominently display the date of manufacture (day, month and year),
or a code indicating the date of
manufacture; and
* If a product label's list of intentionally added ingredients is
incomplete, the company must
include a statement that reads
"For more ingredient information, visit [website URL]."
If a designated list changes after
the above deadlines, a company
has six months to update its online
information and 18 months to update
its product labels. California's Unfair
Competition Law, civil penalties of
up to $2,500 per violation, can be
sought in private litigation. ILMA
members should determine first if they
manufacture and sell covered products
in California and then if any of the
ingredients in their products appear
on a state-designated list.
Let's now turn to New York's
Household Cleansing Product Information Disclosure Program that requires
companies to identify on their websites
their products' ingredients (including
weight) and impurities. As mentioned
previously, New York's Department of
Environmental Conservation (NYSDEC) has delayed initial enforcement
of its cleaning product disclosure
program until Oct. 2, 2019.

The program requires manufacturers
of cleaning products which are sold in
New York to disclose the ingredients
of those products on their websites "in
a manner that is obvious, noticeable
and readily accessible." These companies must also identify any ingredients
that are listed as chemicals of concern
on any authoritative lists. Covered
products include "soaps and detergents
containing a surfactant as a wetting
or dirt emulsifying agent and used
primarily for domestic or commercial
cleaning purposes, including but not
limited to the cleansing of fabrics,
dishes, food utensils and household
and commercial premises." The
New York program does not include
cleansing products used primarily in
industrial manufacturing, production
and assembling processes.
New York requires manufacturers to
update their disclosures each time the
ingredients in a product change, a new
product is introduced to the market
or a list of chemicals of concern is
changed to include an ingredient
present in any of their products. Disclosure updates must be made within
six months.
As I previously mentioned, Oct. 2,
2019, is the first compliance deadline
for the following:
* Intentionally added ingredients,
other than flavor ingredients; and
* Nonfunctional ingredients present above trace quantities.
Companies with fewer than 100
employees have until July 1, 2020,
to comply. The second compliance

deadline is July 1, 2020, by which
time all affected manufacturers must
post the required information for the
following:
* Fragrance ingredients;
* Listed nonfunctional byproducts
present at or above 100 ppm;
* Listed nonfunctional contaminants present at or above 100
ppm;
* Information regarding investigations and research concerning
effects on human health and the
environment; and
* Information regarding Category
3 GHS Skin Irritants and GHS
Aquatic Toxins.
New York provides no exceptions
to the second deadline. The third and
final compliance deadline is Jan. 1,
2023, by which manufacturers must
post additional required information.
This column only scratches the
surface of the California and New
York programs, so seek appropriate
counsel about scope and compliance.
The use of expanding state, federal
and international lists of chemicals
of concern increases the likelihood
of being added to one of these states'
disclosure lists, and the creation of a
commercial nightmare with conflicting state requirements.
