USDA Expands
Procurement Preference
for Biobased Products

T

he U.S. Department of
Agriculture's (USDA) Office
of Procurement and Property
Management recently promulgated
a final rule that became effective on
Aug. 5, 2019, amending its "Guidelines
for Designating Biobased Products for
Federal Procurement" (Guidelines).
The USDA added 30 sections to the
Guidelines with product categories
where biobased products are intended
to receive procurement preference by
federal agencies and their contractors.
Biobased products are derived from
plants and other renewable agricultural,
marine and forestry materials and
provide an alternative to conventional
petroleum-derived products. The USDA
said in its final rule that the 30 new
product categories contain finished
products that are made, in large part,
from intermediate ingredients that have
been designated for federal procurement
preference. Further, the USDA amended
the existing designated product categories of firearm lubricants and general
purpose de-icers, as well as laundry
products and water-clarifying agents.
Many of you are familiar with the
USDA's BioPreferred Program. When
the USDA designates by rule a product
category for preferred procurement
under its BioPreferred Program,
manufacturers of products under the
designated category can qualify their
products for procurement preference
if they contain at least the minimum
biobased content established for the
particular designated product category.
After the USDA designates a product

category, procuring federal agencies
generally must purchase biobased
products within that designated product category where the procurement
contract exceeds $10,000, or where the
quantity of such products or functionally equivalent products purchased over
the preceding fiscal year was $10,000 or
more. The federal government spends
over $500 billion each year on goods
and services. Reports on purchases of
biobased products by federal contractors are collected on the government's
System for Award Management.
Under the amended Guidelines, the
USDA said it set the minimum biobased
content for each new product category
based on products for which it has
biobased content test data. The USDA
obtains biobased content data from
product manufacturers and vendors when
they apply to use the USDA's voluntary
Certified Biobased Product label. In
order to be certified to display this label,
the product must undergo biobased
content testing by an independent,
third-party lab using ASTM D6866,
"Standard Test Methods for Determining
the Biobased Content of Solid, Liquid,
and Gaseous Samples Using Radiocarbon Analysis." The USDA notes that it
maintains the submitted test data in its
BioPreferred Program database.
It is important to note that some
products that fall under the biobased
product categories designated for federal procurement preference under the
USDA BioPreferred Program overlap
with product categories established
under the Environmental Protection

Agency's (EPA) Comprehensive Procurement Guideline (CPG) Program
for products containing recovered
or recycled materials. The EPA's list
of CPG Program product categories
is available on the agency's website.
Re-refined motor oils and transmission fluids are categorized both by the
USDA in the Guidelines and by the
EPA in its CPG Program.
Let me add one more layer of complication. The federal government has
a sustainable purchasing program that
includes three mandatory procurement
preference programs for designated
products: the USDA's BioPreferred Program; the EPA's CPG Program; and the
Environmentally Preferable Purchasing
Program. Agencies are encouraged to
use these three programs when purchasing products and services.
The USDA also pointed out in its final
rule that many biobased products may be
available for purchase by federal agencies
through the AbilityOne Program. Under
this buying program, organizations, such
as the National Industries for the Blind
and SourceAmerica, offer products and
services for preferred procurement by federal agencies. Some of the products under
the Guidelines' product categories are
available in AbilityOne's catalog, which is
frequently updated with new products.
Pardon the pun, but the goods that
are afforded procurement preference
under the USDA's BioPreferred Program are fluid. Along with the federal
government's significant buying power,
ILMA members should closely follow
the USDA's revised Guidelines. Engine
