Credit Unions Gain
Traction in ADA Fight

C

redit unions facing litigation
threats over unclear website
accessibility requirements
under the Americans with Disabilities Act (ADA) have gained traction
in court and toward clearer guidance in
recent months.

NAFCU senior staff met with the
Department of Justice's Disability Rights
Section in March to discuss solutions to
fix the current regulatory void related
to standards for website accessibility for
entities such as credit unions. NAFCU
and its members strongly support the
protections of the ADA and efforts to
ensure individuals with disabilities are
not discriminated against and have equal
access to financial services. However, the
association believes this is best achieved

through clear guidance and standards for
website compliance, not through meritless and costly lawsuits.
In April, a federal district court in
Virginia for the second time dismissed
a lawsuit against Northwest Federal
Credit Union as it again determined
that the plaintiff to such a lawsuit did
not have standing to sue the credit
union because he was not eligible for
membership and would not likely use
the credit union's services. NAFCU
has filed seven amicus briefs to support credit unions; of those, five have
resulted in dismissals.
On the legislative front, the House of
Representatives in February passed
NAFCU-supported legislation to

address public accessibility concerns
under the ADA, which came after
months of NAFCU engagement on
Capitol Hill. Ahead of passage, lawmakers on the House floor had a colloquy
to discuss website accessibility - this
conversation clarified the congressional
intent of the legislation and would allow
those receiving demand letters related
to website accessibility to have time to
come into compliance. The bill awaits
action in the Senate.
More than a hundred credit unions in
25 states have received demand letters
over alleged ADA violations. NAFCU
will remain diligent and engaged with all
stakeholders as ADA concerns persist.

Berger Promotes AACUC,
NAFCU Collaboration
Berger noted that many credit unions are
represented by NAFCU and the AACUC,
as well as other credit union advocacy
groups, which makes it important that
the organizations continue to coordinate
on shared interests for the industry.
Berger will also speak at the AACUC's
Annual Conference in August.
